Liability for Long Beach Semi-Truck Accidents

Truck drivers must operate with an abundance of caution to avoid collisions. They must exercise due care to not hit any pedestrian in the roadway. This is true, even when a pedestrian is outside of a marked crosswalk. Pursuant to CA Veh Code § 22350, no person shall operate a vehicle upon a roadway at a speed greater than would be reasonable and safe given the weather, visibility, and other prevailing traffic conditions. If a truck driver fails to slow down to avoid hitting a pedestrian in the roadway, this could form the basis of a negligence claim. There are many federal regulations for truck drivers designed to prevent accidents.

  • Hours of Service Rules: There are limits related to how long truck drivers are allowed to work in any given day or week. Truck drivers must not drive more than 11 hours per day in a 14-hour driving window. They must take a 30-minute break after driving for 8 hours.
  • Drug and Alcohol Testing: Truck drivers must undergo pre-employment drug testing. Commercial drivers are held to a much stricter standard with respect to what is considered intoxicated. A truck driver is considered impaired if they have a blood alcohol concentration of 0.04% or higher.
  • Medical Certification: All truck drivers must pass a physical exam that is administered by a medical examiner. These exams evaluate the driver’s vision, hearing, and overall health. Truck drivers should not have health conditions that could impair their ability to operate a vehicle safely.
  • Commercial License: Truck drivers are required to obtain a commercial license. This necessitates that they undergo uniform testing and training. They must be intimately familiar with how trucks operate in a variety of different real-world scenarios.

Depending on the facts of any case, there could be several liable parties for any truck accident. This includes the company that employed a truck driver. As a general principle, employers are liable for the wrongful actions of their employees–insofar as those employees were operating within the course and scope of their job duties. For example, a truck driver may have been transporting goods on an official route. However, truck carriers will often try to limit their legal exposure for accidents by hiring truck drivers as “independent contractors.”

Determining Fault in Long Beach Pedestrian Accidents

Thousands of people are killed or seriously injured every year in accidents with commercial trucks. According to the National Safety Council, “in 2023, 114,552 large trucks were involved in crashes resulting in an injury, a 4.7% decrease from 2022. Since 2016, the number of trucks involved in injury crashes has increased 12%, while the involvement rate per 100 million large truck miles driven has remained the same at 35.” It is essential that these accidents are properly investigated so that fault can be determined.

  • Eyewitnesses: In many circumstances, truck accidents will be witnessed by several people. Gathering their testimony can be crucial to determining what led up to a collision.
  • Police Investigation: The police should be called to the scene of a truck accident as soon as possible. They can begin investigating and give their initial assessment on what happened. But police reports are not perfect, and they may contain errors.
  • Medical Records: When a person is injured or killed in a collision, medical records can help piece together how the accident unfolded. For example, they can reveal which direction a person was facing when they were hit by a vehicle.
  • Event Data Recorders: Most commercial trucks are equipped with event data recorders (EDRs). These devices function in much the same way as the black box on an airplane. They can provide valuable information about the speed of a truck during a collision and several other factors.

Truck accidents can be very complex events. The factors that contribute to any truck accident can take place several days, weeks, or months beforehand. These accidents are often highly preventable. This is particularly true if a pedestrian is hit. There are really no reasons that a truck driver should ever hit a pedestrian, even if they are in the middle of the road. These accidents nearly always involve some amount of negligence. The family of any person killed due to the negligent actions of a truck driver may be able to seek some measure of accountability through a wrongful death claim.
