Liability for Kern County Semi-Truck Accidents
Semi-trucks can weigh 80,000 lbs and are difficult to operate in the best of circumstances. Many accidents involve truck drivers making dangerous left turns. Pursuant to California Vehicle Code 21801, the driver of any vehicle intending to turn left upon a roadway must first yield the right-of-way to any vehicle traveling from the opposite direction that is close enough to pose a hazard. If a truck driver turns into the path of a motorcyclist, this could be construed as negligence. Several factors could contribute to any truck accident.
- Reduced Visibility: Truck accidents are much more likely to occur during the early morning hours and late evening when visibility is reduced.
- Inclement Weather: Another major cause of truck accidents is poor weather conditions. In particular, rain can dramatically increase the time it takes for a truck driver to come to a complete stop.
- Dangerous Turns: Trucks have a wide turning radius, which can make them more susceptible to side impact collisions.
- Fatigue: Truck drivers are often asked to work long hours. They may naturally become dangerously fatigued.
Depending on the facts of any case, there could be several liable parties for any truck accident. This includes the employer that a truck driver was working for. In California, employers can be held vicariously liable for the wrongful actions of their workers who were performing their job duties. However, truck companies will normally hire their drivers as “independent contractors” to reduce their legal exposure for accidents.
Preventing Kern County Truck Accidents
Commercial trucks are among the most dangerous vehicles on the roadway. According to the U.S. Congress, “In 2015, large trucks were involved in more than 400,000 motor vehicle crashes serious enough to be registered by police, with nearly 100,000 of those crashes causing injuries and around 3,600 resulting in fatalities.” It is imperative that truck drivers and carriers take certain measures to prevent accidents.
- Maintenance: Truck companies should ensure that all of their vehicles are routinely inspected and well maintained. These vehicles have a high utilization rate and are prone to breaking down without proper care.
- Planning: Truck drivers should only travel through planned routes that minimize left turns and avoid high-traffic areas.
- Regulations: Truck companies should ensure that all of their drivers are adhering to federal regulations. Truck drivers must limit the hours they work per day. They must also take 30-minute rest breaks after driving for 8 hours.
- Training: Driver training is essential to preventing truck accidents. Inexperienced truck drivers are much more likely to be involved in collisions.
Truck drivers are put under an enormous amount of pressure to complete their routes as quickly as possible. This could easily lead truck drivers to form unsafe driving habits. Among other things, they may skip required brakes or travel above the speed limit. When these drivers are involved in collisions, they will nearly always deny responsibility for what happened. This is why it is so important that all fatal collisions are properly investigated by an independent party.
