Liability for Fullerton Truck Accidents
Given the inherent dangers of operating a large vehicle, truck drivers must exercise a great deal of care around pedestrians and bicyclists. Many collisions involve drivers that are traveling at unsafe speeds. Pursuant to California Vehicle Code 22350, no person shall operate a motor vehicle at a speed greater than would be reasonable or prudent given the prevailing traffic and road conditions. When a truck driver fails to slow down to avoid hitting a pedestrian, this could be considered negligence. There are many ways that a truck driver could have contributed to a pedestrian collision.
- Blind Spots: A truck driver may have failed to check their blind spots before changing lanes or turning at an intersection.
- Follow Distance: A truck driver may have been following other vehicles or scooter riders at an unsafe distance.
- Fatigue: A truck driver may have allowed themselves to become dangerously fatigued.
- Traffic Regulations: A truck driver may have failed to properly yield to a pedestrian at a marked crosswalk.
Driving a truck can be difficult in the best of circumstances. It is essential that truck drivers become thoroughly familiar with how their vehicle operates. But in far too many situations, these accidents involve drivers that are traveling too fast or failing to properly scan the road ahead of them. To make matters worse, they and their insurance providers will virtually never accept responsibility for collisions. This is why it is so important that truck accidents are properly investigated by an independent party.
Third-Party Liability for Fullerton Scooter Accidents
As electric scooters and other micromobility devices have grown in popularity, so too have the number of accidents involving these vehicles. According to one study from the University of California, San Francisco, “e-bicycle injuries dramatically increased from 751 in 2017 to 23,493 in 2022, and e-scooter injuries rose from 8,566 to 56,847 over that timeframe. Altogether, there were nearly 2.5 million bicycle injuries, more than 304,000 scooter injuries, 45,586 e-bicycle injuries and 189,517 e-scooter injuries in the U.S.” There could be several liable parties for any accident involving an e-scooter and a truck.
- E-Scooter Manufacturer: The company that manufactured an e-scooter could be held liable if the device lacked reasonable visibility or safety features such as reflectors and lights.
- Truck Company: If a truck driver was working at the time of a collision, their employer could bear some responsibility. As a general principle, employers can be vicariously liable for the wrongful actions of their employees operating within the course and scope of their job duties.
- Truck Rental Service: A truck rental service will typically not be liable for the wrongful actions of someone who rents their vehicle. However, they could be under the legal theory of negligent entrustment. In short, liability may apply if a truck was loaned to someone who was not properly licensed or otherwise incapable of operating the vehicle safely.
- Municipal Entity: Under California Government Code § 835, a city or other municipal entity in California could be liable for a collision if it was caused by a dangerous condition on public property. For example, inadequate signage or markings could force cyclists and e-scooter riders into dangerous proximity with traffic.
When investigating any truck accident, it is important to consider whether or not there is a history of similar collisions where the accident took place. If there is a history of similar collisions at a particular location, it could easily point to underlying roadway defects. These accidents could also serve as constructive notice of a dangerous condition with the roadway. Victims of truck accidents are protected by a number of laws. They are able to hold all liable parties accountable through a civil action.
