Liability for Long Beach Pedestrian Accidents
Drivers must exercise due care to avoid collisions with pedestrians in the roadway. This necessitates that they maintain a safe speed at all times. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” Drivers should take several other actions to avoid collisions.
- Scanning: Drivers should continuously scan the road ahead of them for potential hazards.
- Rest: Drivers should be well rested before heading out onto the road. Driving while fatigued can be just as dangerous as driving while intoxicated.
- Maintenance: Drivers should ensure that their vehicles are routinely inspected and well maintained.
- Blind Spots: Drivers should check their blind spots before turning or changing lanes in the roadway.
If a driver fails to slow down to avoid hitting a pedestrian in the roadway, this may be construed as negligence. There could be several liable parties for any pedestrian accident. For example, if a pickup truck was being used for commercial purposes, the business entity that owns the truck could be legally responsible. Pickup trucks and vans are routinely used for business purposes, including construction, landscaping, and transportation.
Steps to Take After a Long Beach Pedestrian Accident
Thousands of pedestrians are killed or seriously injured every year across California and the United States. According to the Governors Highway Safety Association, “Drivers struck and killed 7,148 people in the United States last year, enough to fill 31 Boeing 737s, according to a new report from GHSA.” It is important that certain actions are taken after any pedestrian accident.
- Police Investigation: The police should be called to the scene as early as possible so they can begin collecting evidence and interview potential eyewitnesses.
- Evidence Preservation: All evidence related to the collision should be collected so that it can be examined.
- Medical Records: Any medical records related to the collision should be gathered. They can provide important insights into how any collision occurred.
- Independent Review: Police reports are often far from exhaustive and may contain errors. It can be useful to have any fatal pedestrian accident independently reviewed by a team with experience in personal injury claims.
Pedestrian accidents are often highly preventable. They tend to involve situations where drivers are traveling too fast for the prevailing conditions or failing to properly scan the road ahead of them. Any person injured in a pedestrian accident may have legal recourse through a civil claim. This right extends to the family member of any person who died due to the negligence of another driver. They are able to seek some measure of accountability through a wrongful death claim.
