Liability for Los Angeles County Electrocution Accidents
Employers in California have a legal obligation to protect workers from reasonably foreseeable sources of harm. This is particularly important for companies that engage in tree trimming. As a profession, tree trimmers have one of the highest fatality rates. When a worker is killed on the job, they or their family will typically have recourse through the workers’ compensation system. This is a no-fault insurance scheme designed to help workers after an accident. Having said that, tree trimming companies should take certain measures to protect their workers from electrocutions.
- Electrical Survey: Prior to performing any tree trimming job, the work zone should be inspected for electrical hazards.
- Training: Workers should be trained to recognize electrical hazards and maintain a minimum of ten feet of clearance.
- Personal Protective Equipment: Workers should be provided with adequate personal protective equipment to protect against electrical hazards.
Depending on the facts of any case, there could be several liable parties for any tree trimming accident. In particular, the company that manufactured one of the boom lifts that many tree trimmers use could be legally responsible. These devices should be equipped with certain safety features that warn about the presence of live electrical hazards. If a landscaping truck lacked adequate safety features, this could form the basis of a product liability claim.
Steps to Take After Los Angeles County Electrocution Accidents
Deaths and serious accidents remain quite common among tree trimmers. According to data gathered by OSHA, an estimated 84% of all deaths involving tree trimmers involved situations where they came into contact with power lines. It is important that certain actions are taken after any tree trimming accident.
- Medical Records: All medical records related to injuries should be gathered and carefully reviewed.
- Workplace Records: All of the workplace records related to the accident should be collected as well.
- OSHA Report: After OSHA creates a report of the incident, this should be carefully studied.
- Legal Review: The unique facts of any workplace electrocution accident should be carefully considered by an experienced legal team.
It can be difficult to know where to begin after any workplace fatality. The surviving family members of any worker who died should consider all of their legal options. They may be able to pursue some measure of justice and accountability through a civil action. There are, however, statutes of limitations associated with pursuing civil claims. Failing to act within the statute of limitations can result in a permanent forfeiture of your rights.
