Liability for Placer County Police Shootings
Police officers have a legal obligation to only use lethal force as an absolute measure of last resort. Pursuant to California Assembly Bill No. 392, the authority to use lethal force must be used judiciously and with respect to the sanctity of all human life. It should only be used to protect officers and others from serious physical harm or death. Police departments should take certain measures to prevent unnecessary police shootings.
- Policies: Police departments should create and enforce use of force policies that make it clear when lethal force is acceptable.
- Training: Police departments should invest in high-quality training that promotes de-escalation techniques and crisis intervention.
- Supervision: Police departments should adequately supervise the conduct of their officers and ensure that they are wearing body cameras when they interact with the public.
Law enforcement agencies have a great deal of discretion on how they perform their duties. But at no point are they allowed to use excessive force. According to 42 U.S. Code § 1983, every person who, under the color of law, deprives someone of their rights afforded under the Constitution, shall be liable to the injured party in an action at law.
Steps to Take After Placer County Police Shootings
Police encounters remain a considerable source of serious injury and death for citizens across California in the United States. According to the Law Enforcement Epidemiology Project, “At least 10,547 civilians have been killed by law enforcement officers.” It is important that certain actions are taken after any fatal police encounter.
- Eyewitnesses: All of the contact information of eyewitnesses should be sought. They can play a crucial role in establishing what took place in a lead-up to any lethal encounter.
- Body Cameras: Body camera footage from all of the officers involved should be carefully reviewed. Police officers in California are required to wear body cameras in most instances.
- Medical Records: Medical records and autopsy reports related to any encounter should be gathered.
- Legal Review: The family of any person killed in a police shooting should carefully consider their legal options with an experienced civil rights attorney.
Police shootings are often highly preventable. In many situations, they involve encounters where police officers are either unwilling or unable to de-escalate. To make matters worse, police agencies will virtually never accept responsibility if they kill or seriously injure someone. This is one of the reasons it is so important to have these encounters properly reviewed by an outside party.
