The force of the impact caused him to be ejected into the left lane of the roadway. He was then struck by a Toyota Tundra pickup truck.

Paramedics were called to the scene of the collision to help the victim. Sadly, Scott Renton later died due to the severity of his injuries.

A full investigation into the collision remains ongoing.

Liability for Pleasanton Car Accidents

Every driver in California has a legal obligation to use caution to avoid car accidents. Drivers must be particularly cautious around motorcyclists, who can be difficult to spot at times due to their naturally small profile. Many collisions with motorcycles involve drivers that make dangerous lane changes. According to California Vehicle Code 22107, no person shall turn a vehicle from a direct course upon a roadway until such movement can be made with reasonable safety. There are many other ways that a driver may have acted negligently before colliding with a motorcyclist.

  • Follow Distance: A driver may have been following a motorcycle at an unsafe speed that did not give them enough room to brake in the event of an emergency.
  • Speed: Drivers are substantially more likely to be involved in a collision if they are traveling at an unsafe speed. What many drivers do not realize is that traveling the speed limit could be dangerous depending on the prevailing road conditions.
  • Driver Distraction: Another major cause of car accidents is driver distraction. A driver may be paying attention to their phone and fail to notice a motorcycle in their proximity.

When drivers fail to slow down to avoid colliding with a motorcyclist, this may be construed as negligence. It is also possible that liability for any collision could extend beyond the driver deemed to be at fault. In particular, if a motorcycle was being used for commercial purposes, the company that owned or operated that vehicle could bear some liability for a crash. Generally speaking, employers in California can be held vicariously liable for the wrong actions of their workers who are operating within the course and scope of their job duties.

Steps to Take After Pleasanton Car Accidents

Many people are seriously injured or killed every year in motorcycle collisions. According to the National Safety Council, “Although motorcycles make up only 3% of all registered vehicles and 0.6% of all vehicle miles traveled in the United States, motorcyclists accounted for 15.5% of all traffic fatalities and 3.4% of all injuries in 2023.” Several actions should be taken after any fatal car accident.

  • Police Report: The police report for the accident should be collected and reviewed.
  • Photos: All of the photos of the accident site should be gathered. They can help reveal what happened. For example, a lack of skid marks can show that a driver did not attempt to brake.
  • Eyewitnesses: All of the contact information for eyewitnesses should be sought.
  • Independent Review: Family members of any person killed in a motorcycle collision should seek an independent review by a team with experience in tort claims.

The vast majority of car accidents are preventable. They tend to involve drivers that are not properly scanning the road ahead of them. It is important for the victims of these collisions to understand that they are protected by a number of laws. Any person injured in a collision may be able to seek some measure of accountability through a civil claim. Surviving family members are also able to pursue some measure of justice. They can hold the responsible party accountable through a wrongful death claim.
