Her mother also sustained a back injury in the collision. A full investigation into the cause of the accident remains ongoing.

Liability for Tulare County Car Accidents

Every driver in California must operate with care to avoid car accidents. This necessitates that they maintain a safe speed with the vehicles ahead of them. According to California Vehicle Code 21703, “The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicle and the traffic upon, and the condition of, the roadway.” There are many different factors that could contribute to a car accident.

  • Speed: Speed remains a common contributing factor for car accidents across California in the United States.
  • Weather: Drivers are substantially more likely to be involved in accidents during periods of inclement weather.
  • Fatigue: Fatigue can also be incredibly dangerous. In fact, staying awake for only 17 hours can reduce a person’s ability to operate their vehicle safely equal to driving with a blood alcohol concentration of 0.05%.
  • Distraction: At freeway speeds, even minor distractions can have major consequences.

If a driver fails to slow down to avoid colliding with another vehicle in their own lane of traffic, this could be construed as negligence. There is a presumption of negligence on the part of any driver that rear-ends another vehicle in their own lane of travel. Even if a vehicle were to stop abruptly, there should be enough distance to avoid a crash. During periods of poor visibility, drivers will need to substantially lower their speed and increase their following distance with other vehicles.

Steps to Take After Tulare County Car Accidents

Car accidents remain a leading cause of preventable injury and death across California and the United States. According to the IIHS, “There were 40,901 deaths from motor vehicle crashes in the United States in 2023. This corresponds to 12.2 deaths per 100,000 people and 1.26 deaths per 100 million miles traveled. The fatality rate per 100,000 people ranged from 4.9 in Massachusetts to 24.9 in Mississippi.” Certain steps should be taken after any person is injured in a multi-vehicle collision.

  • Medical Treatment: Victims should seek medical treatment as early as possible. Many of the injuries associated with a car accident will not be immediately obvious. Moreover, certain injuries may worsen with time.
  • Police: The police should be called to the scene of the accident so that they can create a report and investigate.
  • Evidence: All of the physical and digital evidence associated with the collision should be collected and preserved.
  • Legal Support: Any person injured in a California car accident should carefully consider their legal options with an experienced personal injury attorney. An attorney can examine the unique facts of your case and let you know how much compensation you may be entitled to.

Being injured in a car accident can be traumatic and has long-lasting consequences for a person’s life. Victims are routinely left with high medical bills. They may also need to take extensive periods of time away from work. Any person injured due to the negligent actions of another driver may be able to pursue damages through a personal injury claim. Damages can help cover lost wages, medical bills, and pain and suffering.
