A full investigation into the collision remains ongoing at this time.

Liability for San Rafael Truck Accidents

All drivers in California must use caution to avoid colliding with any pedestrian in the roadway. This requires that they operate at a safe speed at all times. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” Drivers should take several steps to avoid colliding with pedestrians.

  • Scanning: Drivers should continuously scan the road ahead of them for potential hazards.
  • Horns: Drivers should use their horns when necessary to alert pedestrians of their presence.
  • Follow Distance: Drivers should always maintain a safe following distance with a vehicle ahead of them.
  • Maintenance: Drivers must ensure that their vehicles are periodically inspected and well maintained.

When a driver fails to slow down to avoid colliding with a pedestrian in the roadway, this could be construed as negligence. Even if a pedestrian is crossing outside of a marked crosswalk, this does not relieve a driver of their duty of care to avoid colliding with a pedestrian. Liability for a collision could extend beyond any specific driver deemed to be at fault. If a pickup truck or other vehicle was being used for a commercial purpose at the time of a collision, the company that owned the vehicle could be liable. It is extremely common for pickup trucks to be used for commercial purposes at the time of any crash.

Steps to Take After San Rafael Truck Accidents

Far too many pedestrians are killed or seriously injured across California every year. According to one report by US Berkeley, “Fatality trends for pedestrians rose from 2014 to 2022. For bicycle fatalities they rose from 2014 to 2018, followed by a dip from 2019-2021 and a sharp spike in 2022.” Multiple steps should be taken after any truck accident.

  • Police: The police should be called to the scene of the collision so that they can begin investigating.
  • Evidence Preservation: All of the evidence related to the collision should be collected and preserved. This includes the vehicles involved and photos of the accident site.
  • Surveillance Footage: Any type of footage of the collision can be enormously helpful in terms of demonstrating liability.
  • Accident Review: The family of any person who died in a car accident should seek an independent review of the collision with a legal team experienced in tort claims.

Pedestrian accidents are often highly preventable. They tend to involve situations where drivers are not properly scanning the road ahead of them. It is important for accident victims and their families to understand that they are protected by a number of laws. They are able to seek some measure of accountability through a wrongful death claim.
