Liability for San Bernardino County Car Accidents
Every driver in California must exercise caution to avoid colliding with other vehicles or pedestrians in the roadway. This requires that they travel at a safe speed at all times. According to CA Veh Code § 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” Many different factors could contribute to a pedestrian accident.
- Drivers may be distracted by looking at their cell phones.
- Drivers may fail to check their blind spots while making turns.
- Drivers may hit pedestrians during periods of reduced visibility due to weather.
If a driver fails to slow down to avoid hitting a pedestrian in the roadway, this could form the basis of a negligence claim. Even if a pedestrian is outside of a crosswalk, drivers must still slow down and use caution to avoid a collision. Depending on the specific facts of any case, liability for a pedestrian accident could extend to multiple parties beyond any one driver. This is particularly true if a pickup truck or other vehicle was being used for commercial purposes at the time of the crash.
Steps to Take After San Bernardino County Car Accidents
Many pedestrians are seriously injured or killed every year in car accidents across California in the United States. According to the IIHS, “Deaths from motor vehicle crashes with pedestrians have increased 78% since reaching their low point in 2009 and account for 18% of crash fatalities. The rates of pedestrian crash deaths per 100,000 people are highest for people ages 20 and over.” It is important that certain steps are taken after any pedestrian accident.
- The police should be called to the scene so that they can begin investigating.
- Any person who may have witnessed the accident should be interviewed while their memories are still fresh.
- All medical records associated with injury should be collected and preserved.
- The family of any person who died should seek the guidance of a team with experience in accident reconstruction and tort claims.
Pedestrian accidents tend to be highly preventable. In many cases, drivers are simply not paying adequate attention to the road ahead of them. Unfortunately, drivers and their insurance providers virtually never accept responsibility when a pedestrian is seriously injured or killed. This is why it is so important that these incidents are thoroughly investigated by an outside party. The family of any person who died due to the negligent actions of a driver may be able to seek some measure of transparency and accountability through civil action.
