Liability for Oakland Shootings
Property owners in California have a legal obligation to maintain their premises in a reasonably safe condition. Pursuant to California Civil Code 1714, “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.” There are many steps property owners should take to prevent shootings and other criminal activity.
- Security Assessment: Property owners should conduct a thorough security assessment and evaluate what specific security needs they have.
- Guards: In certain locations, property owners may need to hire adequate security guards to keep order at any location.
- Surveillance Cameras: Property owners should install surveillance cameras, which can act as a deterrent to crime.
- Police Response: Property owners should call the police to help defuse conflicts and other disorderly conduct before it escalates.
The level of security a property owner will need to deploy depends heavily on where any business is located. Businesses with a history of crime at a specific location will typically need greater levels of security. The same is true for businesses in high-crime areas. When a property owner fails to take reasonable actions to protect guests from shootings and other criminal activity, this could serve as evidence of negligence.
Steps to Take After Oakland Bar Shootings
Gun violence remains a common occurrence across Oakland and the United States. According to the Pew Research Center, “Nearly 47,000 people died of gun-related injuries in the United States in 2023, according to the latest available statistics from the Centers for Disease Control and Prevention (CDC).” A number of actions should be taken after any shooting in a California business.
- Police Investigation: The police report created after the incident should be carefully reviewed. It can help reveal how any attack unfolded.
- Evidence Preservation: All evidence associated with the shooting should be collected and preserved.
- Site History: The history of violence at any specific location should be understood.
- Compliance: An investigation should be conducted into whether or not any business failed to comply with the city or state ordinances prior to the shooting.
- Legal Review: Any person injured in an Oakland shooting should carefully consider their options with a team experienced in negligence claims.
Shootings at any business may seem like random occurrences. But these incidents are often highly preventable and the results of one or more safety lapses. In particular, there are rules and regulations about how late alcohol can be served in bars and lounges across California. The family of any person who died in a mass shooting may be able to seek some measure of accountability and transparency through a civil action.
