Liability for Chula Vista MTS Bus Accidents
Buses are considered common carriers, and their drivers must operate with an abundance of caution to avoid accidents. According to the Judicial Council of California Civil Jury Instructions, “Common carriers must carry passengers [or property] safely. Common carriers must use the highest care and the vigilance of a very cautious person. They must do all that human care, vigilance, and foresight reasonably can do under the circumstances to avoid harm to passengers [or property].” Several factors could contribute to any bus accident.
- Blind Spots: Buses have large blind spots that can obscure the presence of smaller vehicles.
- Speeding: Buses are much more likely to be involved in collisions if they are speeding.
- Fatigue: Even modest fatigue can substantially impair a driver’s ability to operate their vehicles safely.
If a bus driver fails to slow down to avoid colliding with another vehicle, this could serve as evidence of negligence. Liability for a bus accident could also extend beyond any specific driver determined to be at fault. The company the bus driver worked for could also be legally responsible. Generally speaking, employers can be liable for the wrongful conduct of their workers who are operating within the course and scope of their job duties. Victims of bus accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
- Organ damage
The FM CSA requires buses that carry 15 or more passengers to have at least $5 million in liability coverage. However, bus companies and their insurance providers will virtually never accept responsibility when an accident takes place. Any person injured in a bus accident may be able to pursue some measure of accountability through a personal injury claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
