Liability for Livermore Industrial Accidents

Business owners across California in the United States have an obligation to maintain their premises in a reasonably safe condition. According to 29 U.S.C. § 654(a)(1), “each employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees.” Food distribution facilities should take several actions to protect workers.

  • Vehicle Safety: Employers should do their best to separate pedestrians from forklifts and other vehicles.
  • Loading Docks: All the trailers used in loading docks should have adequate restraints. There should be clear communication between workers at these locations.
  • Machinery: All of the machinery at these locations should have adequate guards to prevent workers from becoming trapped. Workers should also be trained in the proper lockout/tag out procedures.
  • Falls: Workers should be provided with personal fall arrest systems when they work at heights of 6 feet or more. Employers should also enforce non-slip footwear policies.

When a worker is injured or killed in California, they or their surviving family members will typically have recourse to the workers’ compensation system. This is a no-fault insurance scheme designed to help workers. In addition to workers’ compensation, an injured worker or their surviving family members may be able to pursue damages through a third-party liability claim. A third-party liability claim may be possible when an entity separate from a worker’s employer contributed to an accident.

Steps to Take After Livermore Industrial Accidents

Far too many workers are seriously injured or killed every year across California and the United States in preventable accidents. According to the AFL-CIO, “Workplace hazards kill approximately 140,000 workers each year—including 5,283 from traumatic injuries and an estimated 135,000 from occupational diseases in 2023. That is 385 workers each day—and many worker protections are under threat.” Several steps should be taken after any worker is killed at the job.

  • Medical Records: All of the medical records related to the accident should be sought.
  • Workplace Records: All of the internal records related to the accident should be reviewed. These records can reveal violations of safety standards.
  • OSHA: Any report created by OSHA should be carefully examined. This report can help reveal all potentially liable parties.
  • Legal Review: The family of any worker who died in a workplace accident should seek an independent review of the accident by a team experienced in labor laws and civil claims.

The vast majority of workplace accidents are preventable. They often involve situations where employers are violating safety standards to increase worker productivity. To make matters worse, employers and general contractors will virtually never accept responsibility when a worker is killed or injured. This is why it is so important that these incidents are investigated by an outside party. The family of any worker who died in a workplace accident is able to seek some measure of accountability and justice through a civil claim.
