Gilberto Flores Died Following Officer-Involved Shooting in Palm Springs Along East Palm Canyon Drive
PALM SPRINGS, CALIFORNIA (August 1, 2026) – A man identified as Gilberto Flores has tragically died in a Palm Springs police shooting during a potential mental health crisis.
Riverside County officials are saying this occurred around 3:41 PM on May 28, 2026. Police were called to the area after getting multiple reports about a man who was allegedly acting erratically and holding a knife.
Police officers arrived at the scene and encountered Gilberto Flores. Those officers attempted to de-escalate the situation and spoke with him for approximately 40 minutes.
Officers deployed two tasers and a 40mm sponge round. Unfortunately, responding officers shot Gilberto Flores after he allegedly advanced towards them while holding a knife.
Paramedics were called to the scene of the accident to help the injured man. Unfortunately, he was later pronounced deceased at a local hospital.
Liability for Palm Springs Police Shootings
Police officers have a legal obligation to use the least amount of force reasonable to get suspects to comply with their demands. A police department can be liable for any instance where officers use excessive force. According to 42 U.S. Code § 1983, every person who, under the color of law, deprives someone of their rights afforded under the Constitution, shall be liable to the injured party in an action at law. There are many ways that police officers may have used excessive force.
- Hitting: Police officers may have hit a suspect after they were already restrained.
- Shooting: Police officers may have shot a suspect, even though they did not pose a threat to anyone.
- Prone Positions: Police officers may have put a suspect in a prone position that restricted their breathing.
- Chemical Sprays: Police officers may have continued to use chemical irritant or tasers after a suspect was already compliant.
If a police officer uses excessive force and kills a suspect, this could form the basis of a constitutional claim. The department that any police officer worked for could also be liable for instances of excessive force if inadequate training or other institutional failures contributed to a fatal police encounter. When evaluating whether or not any use of force was excessive, courts will take into consideration the totality of circumstances that an officer was facing.
What To Do After Palm Springs Police Shootings
A large portion of fatal police shootings involve people who were struggling greatly with their mental health. According to one study in the Journal of Mental Health, “MBH involvement was associated with 1.5-times higher odds of fatality than MBH-uninvolved shootings and 31% higher odds of injuring an unarmed person vs. person with a gun. Clinician presence was identified in 1% of MBH-involved shootings.” Many actions should be taken after any officer-involved shooting.
- The police report created after the incident should be reviewed.
- All body camera footage from officers involved should be studied.
- Any history of disciplinary actions with the involved officers should be considered.
- The family of any person who died should request an independent investigation by a team experienced in civil rights litigation.
Police shootings tend to be highly preventable in many different situations. Part of the problem is that many officers are not properly prepared to de-escalate encounters. This is particularly true when the suspect involved may have underlying mental health issues. Sadly, police departments are not likely to accept responsibility if one of their officers is involved in a fatal encounter. The family of any person who died due to the negligent conduct of police officers may be able to pursue some measure of accountability through a civil claim.
