Liability for Lake Los Angeles Pedestrian Accidents

Drivers have a legal obligation to exercise due care to avoid hitting any pedestrian in the roadway. This requires that they continuously scan the road ahead of them and maintain a safe speed for the prevailing road conditions. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” There are many ways that a driver may have acted negligently prior to hitting a pedestrian.

  • A driver may have been intoxicated by their use of alcohol and other substances.
  • A driver may have made an unsafe lane change into the path of a pedestrian.
  • A driver may have failed to use their horn to alert pedestrians of their presence.
  • A driver may have failed to slow down in an area with heavy pedestrian traffic.

If a driver fails to take evasive action to avoid a pedestrian in the roadway, this could serve as evidence of negligence. Even if a pedestrian is stationary on a road, this does not relieve a driver of their duty to use caution. Depending on the facts of any case, liability for a pedestrian collision could extend to several parties. For example, a vehicle may have been used for some type of commercial purpose prior to a collision. In particular, a number of vehicles are used for delivery services in the Los Angeles area.

Steps to Take After Los Angeles Pedestrian Accidents

Los Angeles continues to have very high rates of pedestrian collisions each year. According to the LA Department of Transportation, “Pedestrians are involved in 38% of fatal and severe injury collisions, while 16% of all trips in LA are made on foot. 11% of LA intersections are signalized, but they account for over 50% of fatal and severe injury collisions.” It is important that certain steps are taken after any pedestrian collision.

  • The police should be called to the scene of the accident to investigate the crash.
  • All physical evidence related to the crash should be preserved.
  • Any surveillance footage that may have captured the collision should be sought.
  • The family of any person who died should seek an independent review by a team experienced in accident reconstruction.

Pedestrian accidents tend to be highly complex. The factors that contribute to any pedestrian collision could take place long before the actual event. In many cases, municipal infrastructure plays a large role in these collisions. As Los Angeles County has continued to grow in recent years, public infrastructure for pedestrians has not kept pace. More and more pedestrians are using increasingly dangerous walkways and intersections.
