Liability for West Covina Truck Accidents
Every driver in California has a legal obligation to exercise due care to avoid colliding with other vehicles in the roadway. This requires that they maintain adequate separation with all of the cars ahead of them. According to California Vehicle Code 21703, “The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicle and the traffic upon, and the condition of, the roadway.” There are several factors that could contribute to any truck accident.
- Speed: Drivers are substantially more likely to collide with other vehicles if they are traveling at an unsafe speed.
- Fatigue: Driving while fatigued can actually be just as dangerous as driving while intoxicated.
- Vehicle System Failures: If any part of a vehicle malfunctions, this could easily contribute to a major car accident.
If a truck driver fails to slow down to avoid colliding with a vehicle ahead of them, this could form the basis of a liability claim. Liability for any specific accident could extend to several parties beyond any specific driver determined to be at fault. The company that owned a truck could be liable for an accident. In general, employers in California can be vicariously liable for the negligent actions of their workers who were operating within the course and scope of their job duties.
Steps to Take After West Covina Truck Accidents
Car accidents are one of the leading causes of preventable injury and death in California and the United States. According to the National Safety Council, “Between 1913 and 2024, motor-vehicle deaths per 10,000 registered vehicles decreased 96%, from 33 to 1.44, respectively. In 1913, only 1.3 million vehicles were registered, and 4,200 people died on the road. In 2023, 297.5 million vehicles were registered, and 42,789 people died on the road.” Several steps should be taken after any truck accident in Los Angeles County.
- The police report created after the crash should be sought.
- Any person who may have witnessed the collision should be interviewed.
- All of the physical evidence associated with the crash should be preserved.
- The family of any person killed in a collision should seek an independent investigation by a team experienced in accident reconstruction.
Car accidents are often highly preventable. They tend to involve situations where drivers are not properly scanning the road ahead of them. It is important that the victims of these collisions understand that they do have legal options. They are able to pursue some measure of justice and accountability through a civil action. This right extends to surviving family members of any person killed in a collision. They can hold the responsible parties accountable through a wrongful death claim.
