Liability for San Diego County Truck Accidents
All drivers in California have a duty of care to operate their vehicle safely so they will avoid hitting other vehicles and pedestrians. Pursuant to California Vehicle Code 21954, drivers must use caution to avoid colliding with any pedestrian in the roadway, even if they are outside of a crosswalk. If a driver fails to slow down to avoid colliding with any pedestrian in the roadway, this may be construed as negligence. There could be several liable parties for any pedestrian collision.
- Multiple Drivers: It is possible that several drivers could be held at fault for a collision, especially if one vehicle pushes another vehicle into the path of a pedestrian.
- Municipal Entity: A city or other municipal entity could face liability for a collision if it was caused by a dangerous condition on public property. A dangerous condition may exist if overgrown foliage blocks a driver’s line of sight at an intersection.
- Business: Many pickup trucks are used for commercial purposes. When a vehicle is being used for a commercial purpose, the company that owned or operated that vehicle could face responsibility if their driver acts negligently and hits someone.
Preserving evidence is very important after any pedestrian collision. Drivers that cause accidents will almost never accept responsibility. It is more likely that they will blame the victim for what happened. Medical records, police reports, and surveillance footage can go a long way towards establishing what happened. Even if a pedestrian is partially at fault for a collision, this will not bar them or surviving family members from pursuing accountability through a civil claim.
Preventing San Diego County Pedestrian Accidents
Despite efforts to reduce pedestrian accidents in San Diego, they remain alarmingly common. According to NBC San Diego, “It will soon be 10 years since the city of San Diego adopted Vision Zero with the goal of having no non-motorist traffic deaths on city streets. However, a report published by Circulate San Diego, called “Vision Zero At Ten Years,” found there are more pedestrian deaths occurring now than when the initiative began in 2015.” There are many steps that cities can take to help prevent pedestrian fatalities.
- Design: Cities should consider redesigning dangerous streets and intersections. The streets can be equipped with high-visibility markings and better lighting to make pedestrians more visible.
- Speed: Cities should heavily enforce traffic violations likely to lead to pedestrian accidents, including speeding. They should also install traffic calming measures in areas where drivers are known to speed.
- Study: Pedestrian accidents are not evenly distributed throughout all intersections and streets in San Diego. City officials should study which roads are the most problematic and address them first.
It could be hard to know where to begin after any pedestrian collision. This is particularly true when family members lose someone due to the negligence of another driver. The family of any person who died due to the negligent actions of a driver may be able to pursue accountability through a wrongful death claim. There are, however, statutes of limitations that must be observed in all civil actions. Failing to act within the statute of limitations can foreclose a person’s ability to pursue a claim.
