When police arrived, they encountered Kiavik Miranda. Officers issued multiple commands for him to drop the metal tire iron.

Paramedics were called to the scene to help the man. Unfortunately, Kiavik Miranda was beyond medical aid and died at the scene.

A full investigation into the Corona police shooting remains ongoing.

Liability for Corona Police Shootings

Police officers should only use lethal force as a last resort. Law enforcement can be liable for the excessive force of their officers. According to 42 U.S. Code § 1983, every person who, under the color of law, deprives someone of their rights afforded under the Constitution, shall be liable to the injured party in an action at law. There are many ways that police officers can contribute to a police shooting.

  • De-Escalation: Police officers may have failed to use proper de-escalation techniques.
  • Tactical Errors: Police officers may have committed tactical errors by rushing in without properly assessing the situation.
  • Warnings: Police officers may have failed to give clear verbal warnings when possible.
  • Use of Force Continuum: Police officers may have failed to follow a use of force continuum. Police officers should start with the least amount of force necessary and work up from there.

Police officers are required to be especially careful if they are dealing with a suspect that may be in the midst of a mental health crisis. There are additional policies and procedures that they must follow if this is the case. But in far too many situations, officers are not properly trained to deal with these encounters. This leads to situations where they are much more likely to use lethal force.

Steps to Take After Corona Police Shootings

Far too many people are killed or seriously injured every year in California police shootings. Many of these encounters involved people in serious mental distress or under the influence. According to the Public Policy Institute of California, “More than four in ten people treated for non-fatal gunshot wounds from a police encounter were diagnosed with a mental health condition, an alcohol- or substance-related disorder, or both.” Several actions should be taken after any fatal police encounter.

  •  Body Cameras: All body cam footage from the officers involved should be sought.
  • Medical Records: All medical records related to the shooting should also be gathered. This includes any autopsy report that may have been created.
  • Witness Testimony: The contact information of witnesses should be sought. They can play a crucial role in establishing what may have led up to the shooting.
  • Legal Investigation: Surviving family members should request an independent investigation by a team of experienced civil rights attorneys. They can help identify all of the ways that police officers may have acted negligently.

Police shootings tend to be very preventable. Officers should do their very best to de-escalate encounters. When this doesn’t work, they should typically rely on less lethal options, such as tasers. It is important for the victims of police brutality and their surviving family members to understand that they do have rights. In particular, the family of any person who died in a police shooting may be able to seek some measure of accountability through a wrongful death claim.
