Liability for Fresno County Oil Rig Accidents
When a worker is injured or killed in California, they or surviving family members will typically have recourse through the workers’ compensation system. This is a no-fault insurance scheme designed to help employees who are injured during the course of their work. There is no need for an injured worker to demonstrate that one party was at fault. Having said that, employers should still take several measures to help protect their workers from serious injury or death.
- Safety Program: Employers should develop a written safety program that is tailored to their specific injury and worksite tasks.
- Regulatory Standards: Employers should do everything in their power to comply with all regulatory safety standards. Among other things, workplaces must be free of recognized hazards.
- Training: Employers should train their workers to recognize safety hazards.
- Safety Equipment: Employers should provide workers with all of the personal protective equipment that they will need to be safe on the job.
The vast majority of workplace accidents are preventable and tend to involve clear safety lapses. When a worker is injured on the job, they or surviving family members may also have recourse through a third-party liability claim. A third-party liability claim may be possible if an entity separate from a worker’s employer contributed to an accident. There could be numerous sources of third-party liability for an oil rig accident. This may include general contractors and the company responsible for safety at the worksite.
Steps to Take After Fresno County Oil Rig Accidents
Many people are injured in workplace accidents every year in the United States. According to the Bureau of Justice Statistics, “There were 5,283 fatal work injuries recorded in the United States in 2023, a 3.7-percent decrease from 5,486 in 2022, the U.S. Bureau of Labor Statistics reported today. The fatal work injury rate was 3.5 fatalities per 100,000 full-time equivalent (FTE) workers, down from 3.7 in 2022.” Certain measures should be taken after any workplace accident.
- Medical Records: All of the medical records related to the incident should be collected and preserved.
- OSHA Report: The report that OSHA created following the accident should also be examined. It can provide key insights into what went wrong.
- Legal Review: Fatal workplace accidents should be reviewed by a legal team with ample experience in industrial accidents. This team can help identify all liable parties.
It can be difficult to know where to begin after any workplace accident. Victims may be left with life-altering injuries that prevent them from returning to their profession. In all too many situations, family members must contend with the sudden and tragic loss of a loved one. It is important that victims understand that they do have legal options. In particular, surviving family members may be able to pursue some measure of justice and accountability through a wrongful death claim.
