Liability for Yolo County Truck Accidents
Every driver in California must use care to avoid colliding with any pedestrian. Pursuant to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” Drivers should take several other measures to avoid collisions with pedestrians.
- Scanning: Drivers should continuously scan the road ahead of them for potential hazards.
- Inspections: Drivers should have their vehicles periodically inspected and maintained.
- Horn: Drivers should use their horns to alert pedestrians of their presence when necessary.
- Blind Spots: Drivers should check their blind spots before changing lanes or making turns.
When a driver fails to slow down to avoid colliding with a pedestrian, this could form the basis of a negligence claim. Liability for a pedestrian accident could extend beyond any driver determined to be at fault. For example, if a pickup truck was being used for commercial purposes, the company that owned or operated the truck could be liable. As a general rule, employers can be liable for the wrongful actions of their employees who were operating within the course and scope of their job duties.
Steps to Take After Yolo County Truck Accidents
Pedestrians lack the protections afforded by motor vehicles and are more likely to be seriously injured in the event of a crash. According to the NHTSA, “the number of pedestrian fatalities has increased since 2009, leading to a 5-year average of 6,502 pedestrian deaths during the 5 most recent years (2017 to 2021).” Many steps should be taken after any California pedestrian accident.
- Police: The police should be called to the scene of the accident so that they can begin investigating.
- Eyewitnesses: Any person who may have witnessed the crash should be interviewed.
- Accident Reconstruction: Investigators may need to perform accident reconstruction to help determine how an accident took place.
- Legal Review: The family of any person who died in a pedestrian collision should carefully consider their legal options with a team experienced in tort claims.
Pedestrian accidents are often highly preventable. In many cases, they involve drivers that are not properly scanning the road ahead of them. These collisions tend not to be evenly dispersed across every street and intersection. Some streets and intersections tend to be highly concentrated hotspots for pedestrian accidents. The family of any person who died in a pedestrian accident may be able to seek some measure of justice and accountability through a wrongful death claim.
