Liability for Sacramento County Jail Deaths
When the state takes control of a person’s autonomy through incarceration, certain constitutional standards must apply. Jails must protect inmates from reasonably foreseeable sources of harm. This necessitates that they provide adequate medical treatment to an inmate throughout the duration of their stay. Jails must take certain steps to keep inmates safe.
- Health Screening: Jails should conduct a thorough health screening for every inmate that enters their care.
- Monitoring: Jails should periodically monitor inmates over the duration of their stay. Inmates with certain medical conditions may need more consistent monitoring.
- Medications: Jails must ensure that inmates receive all of the medications that they need.
- Treatment: Jails must provide inmates with all of the medical treatment that they require. This includes medical treatment in the event of an emergency.
If a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a constitutional claim. Not every instance where an inmate becomes ill in a jail setting will rise to this level. The specific facts of any case will ultimately help determine whether or not deliberate indifference occurred. Generally speaking, jail officials act with deliberate indifference if they know that an inmate is in serious distress and still fail to take action.
Steps to Take After Sacramento County Jail Deaths
Jail deaths remain a far too common occurrence across California and the United States. Many of these deaths involved people who were young. According to Open Justice, “The average age of individuals who died in custody was 52 years old. Those who died of natural causes were older on average (65 years old). Those who died by homicide and suicide tended to be younger (39 and 40 years old, respectively).” Multiple steps should be taken after any inmate death in California.
- Medical Records: All medical records related to the inmate’s death should be collected and preserved.
- Jail Records: Jail records related to the stay should be sought. This includes how often an inmate was checked on by jail staff.
- Legal Review: The family of any inmate who died in custody should seek an independent review of the incident with the team experienced in constitutional law and negligence claims.
Many jails will claim that an inmate death in their care was natural and thus unpreventable. But in many cases, nothing could be further from the truth. A number of inmate deaths listed as natural actually involved some amount of medical neglect. This will include instances where inmates do not receive prompt medical care. By the time an inmate is actually seen, it may already be too late. The family of any person who dies in custody is able to seek some measure of accountability through a wrongful death claim.
