CRESCENT CITY, CALIFORNIA (March 10, 2026) – A man identified as Gabriel Otero has tragically died while in custody at the Pelican Bay State Prison in Crescent City.
The California Department of Corrections and Rehabilitation said that the incident took place on March 9. Correctional officers found Gabriel Otero unresponsive.

His cellmate has been placed in restricted housing. The death is currently being investigated as a homicide. A full investigation remains ongoing.
Liability for Crescent City Inmate Deaths
Jails have a legal obligation to protect inmates from reasonably foreseeable sources of harm. This includes protecting them from attacks at the hands of other inmates. If a jail has particular knowledge of a specific threat against an inmate, they must take action. Failing to take action could form the basis of a constitutional claim. Jails should take a number of measures to protect inmates from violence.
- Jail should ensure that they have plenty of trained correctional officers at the facility at all times.
- Jail should take measures to separate violent offenders from non-violent offenders.
- Jails should house certain inmates in protective custody separately.
- Jail should take measures to ensure inmates do not gain access to contraband that could be used as weapons.
Many inmate deaths that are the result of violence are preventable. They tend to involve situations where jail officials are not properly monitoring inmates in their custody. Another major problem is that jails may choose to house violent inmates with people who have no history of violence. These sorts of errors can have lethal consequences.
Steps to Take After Inmate Deaths at the Pelican Bay State Prison
Attacks and homicides in jails remain a common occurrence. According to the U.S. Department of Justice, “Ten in 100,000 state prisoners died from homicide in 2018, the highest homicide rate in state prisons since 2001.” Many steps should be taken after any inmate dies in custody.
- All of the jail records related to the death should be sought.
- Medical records should be closely reviewed. They can offer an insight into how any death took place.
- There should be a thorough investigation into the actions of jail staff prior to the death.
- The family of any person who died in custody should contact an experienced civil rights attorney.
It can be difficult to know where to begin after losing a loved one in a California prison. To make matters worse, correctional officers will virtually never be totally transparent about what took place. When they do investigate themselves, they will ultimately find that they did nothing wrong. It is important that the family member of any person who died in custody understands that they do have legal rights. They’re able to seek some measure of accountability through a civil claim.
