Victor Hugo Delgado, Robert Miguel Gutierrez-Avalos and Levi Jacob Flores: three young lives lost at the Lincoln Avenue off-ramp
ANAHEIM, CALIFORNIA (September 3, 2026): Three teenagers were killed and a fourth seriously injured when a white Ford Edge carrying four young people veered off the southbound Interstate 5 at the Lincoln Avenue off-ramp south of Euclid Street at about 3:15 a.m. Thursday, according to the California Highway Patrol. The CHP said the SUV left the roadway for unknown reasons, slammed into a guardrail and a concrete pillar, then continued down a sloped concrete embankment and overturned, as reported by MyNewsLA and ABC7. Two occupants were ejected. Two died at the scene and a third died at a hospital.
The Orange County coroner identified the dead as Victor Hugo Delgado, 17, of Santa Ana; Robert Miguel Gutierrez-Avalos, 16, of Santa Ana; and Levi Jacob Flores, 15, of Garden Grove, according to ABC7. The fourth occupant was hospitalized, and NBC Los Angeles reported the survivor was in critical condition. The CHP said apparently none of the occupants wore seat belts and that drugs and alcohol had not been ruled out, per ABC7 and MyNewsLA. NBC Los Angeles reported that investigators consider speed a potential factor and that the driver’s identity had not been made clear.
Liability for Orange County Freeway Rollover Crashes
California Vehicle Code § 22350 (basic speed law) bars driving faster than is reasonable for conditions, and California Vehicle Code § 21658 (lane maintenance) requires a driver to stay within a marked lane. The CHP says speed is a potential factor and impairment has not been ruled out, but California Vehicle Code § 23152 (driving under the influence) applies only if the investigation establishes it, which has not happened. Because the driver has not been identified, the first question is who was at the wheel. California Code of Civil Procedure § 377.60 (wrongful death) allows the parents of each teenager to bring a claim, and Government Code § 835 (dangerous condition of public property) may apply if the guardrail, pillar or embankment at that off-ramp did not perform as safe highway design requires.
- Identity of the driver: The CHP has not said who was driving. Ejection patterns, seating evidence, DNA and witness accounts answer that question.
- Roadside hardware: The SUV struck a guardrail and a concrete pillar before going down an embankment. Whether that hardware met design standards and was maintained is a question for highway engineers.
- Speed and impairment: Investigators consider speed a potential factor and have not ruled out impairment. Neither is confirmed, and toxicology takes weeks or months.
- Restraint use: The CHP said apparently no one was belted. In California, that may reduce a recovery under comparative fault, but it does not eliminate a family’s claim.
A wrongful death action rests on negligence: a duty of ordinary care, a breach, and a death the breach caused. Parents who lose a child may recover funeral and burial expenses, the support and services the child would have provided, and the loss of the child’s love, companionship, comfort, care and society. A claim against a public entity for a dangerous condition at the off-ramp proceeds on a separate and much shorter track. The surviving teenager has his own personal injury claim, and special deadline rules can apply to a minor.
Steps to Take After an Orange County Freeway Rollover Crash
According to the National Highway Traffic Safety Administration, rollover crashes account for a disproportionate share of vehicle occupant deaths, and ejection dramatically increases the risk of death.
- Request the CHP traffic collision report: Ask the CHP for the report number, then request the full report, scene diagram and supplemental investigation.
- Preserve the Ford Edge: The SUV holds data on speed and restraint use and evidence of seating positions. Send a preservation demand before it is salvaged.
- Document the off-ramp: Photograph and measure the guardrail, pillar and embankment quickly, since roadside hardware is often replaced within days.
- Look for video: Caltrans cameras, nearby businesses and dash cameras may have captured the SUV before it left the freeway. Send written requests immediately.
- Review all available coverage: Identify the liability policy on the Ford Edge and each family’s own uninsured or underinsured motorist coverage, which can cover a resident relative.
A California wrongful death lawsuit generally must be filed within two years of the date of death under Code of Civil Procedure § 335.1. If Caltrans or another public entity may share responsibility for the condition of the Lincoln Avenue off-ramp, a government claim must be presented within six months under Government Code § 911.2, a deadline that arrives sooner than families expect.
