Highway 58 east of Edison Road: an eastbound SUV crossed the center divider and hit a westbound car head-on, and both vehicles burst into flames

BAKERSFIELD, CALIFORNIA (September 28, 2026): Veronica Espinoza Roa, 53, of Oakdale was one of four people killed on Monday morning, September 28, when two vehicles collided head-on and caught fire on Highway 58 east of Edison Road, just east of Bakersfield, according to the California Highway Patrol and the Kern County Coroner’s Office, as reported by KGET, BakersfieldNow and 23ABC. The CHP said officers were called to the crash at about 10:27 a.m.
According to the CHP, a 2025 Hyundai Tucson was heading east on Highway 58 while a 2020 Toyota Corolla carrying a driver and two passengers was heading west. For reasons that are still under investigation, the Hyundai veered to the left, crossed the center divider and struck the front of the Toyota. Both vehicles became fully engulfed in flames with everyone still trapped inside, the CHP said.
The driver of the Hyundai and all three people in the Toyota were pronounced dead at the scene. Espinoza Roa was one of the passengers in the Toyota, according to 23ABC. The Kern County Coroner’s Office has continued to release the names of the other victims as identifications are completed, most recently on Monday, October 12, KGET reported. Anyone with information about the crash can call the CHP Bakersfield Area office at 661-396-6600.
The CHP has said it is unknown whether alcohol or drugs played a role. It has not explained why the Hyundai left its side of the highway, how fast either vehicle was traveling, or whether the center divider at that location is part of its review.
Liability for the Highway 58 Head-On Crash
Under California Civil Code § 1714, every driver is responsible for harm caused by a failure to use ordinary care. Vehicle Code § 21650 generally requires drivers to stay on the right half of the roadway, and Vehicle Code § 21651 prohibits driving over a dividing section that separates opposing lanes. When the driver who caused a crash also dies, a claim can generally still be brought against that driver’s estate and auto insurance. Based on what the CHP has released, the questions include:
- Crossing the center divider: The CHP said the Hyundai veered left and crossed into westbound traffic. A vehicle leaving its side of a highway is generally strong evidence of fault, unless investigators find a sudden mechanical failure or another outside cause.
- Three people in the other car: The driver and two passengers in the Toyota had little chance to avoid a vehicle coming across the divider, according to the CHP account. Each of their families may have a separate wrongful death claim.
- A possible vehicle defect: Investigators have not said why the Hyundai left its lane. If a steering, tire or other defect played a role, a product liability claim against a manufacturer may also be examined.
- The fire: Both vehicles burned with the occupants trapped inside. Whether either vehicle’s fuel system or design contributed to the fire may become part of a product liability review.
The families of those who died in the Toyota may bring wrongful death claims under Code of Civil Procedure § 377.60 against anyone found responsible. With several victims, the available insurance may have to be shared among families, so early attention to each claim matters. Uninsured or underinsured motorist coverage on a household auto policy may also apply.
Steps to Take After a Fatal Highway 58 Crash
According to the National Highway Traffic Safety Administration, head-on collisions are a small share of all crashes but a much larger share of traffic deaths. When a crash ends in fire, official reports often hold most of the evidence families will need.
- Request the CHP report: Ask the CHP Bakersfield Area office for the report number and the traffic collision report, including any reconstruction findings, once it is complete.
- Contact the Coroner: The Kern County Coroner’s Office can explain how families receive death certificates, autopsy results and toxicology findings.
- Preserve the vehicles: Ask where the burned vehicles are being stored and request in writing that they not be destroyed. They may hold evidence about steering, brakes or the source of the fire.
- Be careful with insurers: Several insurance companies may contact the families. Avoid recorded statements until you understand your rights.
Wrongful death claims generally must be filed within two years under Code of Civil Procedure § 335.1. If the design or maintenance of the center divider on this state highway is examined, a claim against the State of California is generally due within six months under Government Code § 911.2.
