Harvard Avenue and Paseo Westpark: Woman Dies After Two-Vehicle Collision; Mercedes Driver Arrested on Suspicion of DUI

IRVINE, CALIFORNIA (October 15, 2026): A woman driving a Toyota Corolla died after an Irvine fatal crash at the intersection of Harvard Avenue and Paseo Westpark on Thursday night, October 15, 2026, and the driver of the other car was arrested on suspicion of driving under the influence, according to the Irvine Police Department. KTLA and City News Service also reported the crash, citing Irvine police spokesperson Ziggy Azarcon.
Irvine police and the Orange County Fire Authority responded to the collision at 9:06 p.m., the department said in a news release. Officers found a 2009 Toyota Corolla and a 2023 Mercedes S680, which KTLA described as a Mercedes-Maybach, in the intersection with heavy damage. The woman was trapped in the Toyota and had to be freed by firefighters, Azarcon told KTLA at the scene.
She was taken to Orange County Global Medical Center, where she died from her injuries, according to police. The man driving the Mercedes was detained at the scene and arrested on suspicion of DUI. The Irvine Police Department said additional charges may follow as the investigation continues. He has not been charged, and he is presumed innocent unless proven guilty in court.
The department’s Major Accident Investigation Team is handling the case. Police have not said which direction each car was traveling, whether speed played a role, or what tests were done to support the DUI arrest. These are early accounts. Fault is determined by investigators and, in civil cases, by the courts, and initial findings sometimes change. Anyone who saw the crash or has information is asked to contact Detective Gallegos of the Irvine Police Department.
Liability for Irvine DUI-Related Crashes
California makes it a crime to drive under the influence and cause injury to another person under California Vehicle Code § 23153. Separately from any criminal case, Civil Code § 1714 makes every person responsible for harm caused by a failure to use ordinary care, and when a death results, Code of Civil Procedure § 377.60 identifies the family members who may generally bring a wrongful death claim. In cases involving intoxication, courts may also consider punitive damages under Civil Code § 3294.
- The DUI arrest: An arrest is not a conviction. The criminal case and any civil claim are separate, and a civil case generally uses a lower standard of proof.
- The intersection: Harvard Avenue and Paseo Westpark sits near the Westpark neighborhood. Right-of-way, traffic controls and each driver’s path are details investigators typically reconstruct.
- The vehicles: Event data recorders in modern cars, including a 2023 Mercedes, often store speed and braking data from the seconds before impact. That data can help show how the crash happened.
- Insurance coverage: Claims after a fatal crash usually involve the at-fault driver’s auto policy and, in some cases, the injured person’s own uninsured or underinsured motorist coverage.
These are general principles of California law, not conclusions about this crash, which remains under investigation.
Steps to Take After an Irvine Fatal Crash
The National Highway Traffic Safety Administration reports that about one in three traffic deaths in the United States involves a drunk driver. Families who lose a loved one in a crash involving a suspected impaired driver can generally:
- Request the collision report: Ask the Irvine Police Department for the report number and how to obtain the report once the investigation is complete.
- Follow the criminal case: The Orange County District Attorney decides whether to file charges. Victims’ families have rights under Marsy’s Law, including notice of court dates.
- Preserve evidence: Photos, witness names, dashcam or doorbell video from nearby homes and businesses, and vehicle data can be lost if no one asks for them early.
- Keep records: Save medical, funeral and other expense records, along with any letters from insurance companies, and avoid giving recorded statements before understanding your rights.
Wrongful death and personal injury claims in California are generally subject to the two-year deadline in Code of Civil Procedure § 335.1. Contact an attorney promptly to protect your rights.

We at Carrazco Law, A.P.C., a personal injury and civil rights law firm in Irvine, California, extend our deepest condolences to the family and friends of the woman who died on Harvard Avenue. Two questions remain open: what do vehicle data and any nearby video show about which driver had the right of way, and what did the chemical tests taken after the arrest show? Earlier this month we reported on the death of Rhiannon Lawler in a suspected DUI red-light crash in Daly City.
