Kasson Road North of Linne Road: Tracy Man Killed After a Driver Tried to Pass a Tractor-Trailer

TRACY, CALIFORNIA (October 16, 2026): A 22-year-old Tracy man was killed in a four-vehicle Tracy head-on crash on Kasson Road, just north of Linne Road, shortly before 5 p.m. on Friday, October 16, 2026, according to the California Highway Patrol. The crash involved a Toyota, a Honda sedan, a scooter-style motorcycle and a Peterbilt tractor with a tank trailer, the CHP said, as reported by FOX40 (KTXL) and the Tracy Press. The man who died has not been publicly identified.
According to the CHP, a 43-year-old Tracy man was driving a 2021 Toyota north on Kasson Road behind a Peterbilt tractor-trailer driven by a 58-year-old Modesto man. The Toyota driver tried to pass the tractor-trailer with what the CHP described as insufficient clearance and crossed into the southbound side of the road. A 26-year-old Manteca man riding a scooter-style motorcycle south on Kasson Road swerved onto the west shoulder to avoid the Toyota, the CHP said.
The Toyota then struck a 1994 Honda sedan head-on, the CHP said. The Honda, driven by the 22-year-old man, was pushed into the motorcycle, and the Toyota was pushed into the Peterbilt. Both the Honda and the Toyota overturned on the west shoulder. The Honda driver was pronounced dead at the scene. The Toyota driver was taken to San Joaquin General Hospital with major injuries and was later arrested, according to the CHP. He is presumed innocent unless proven guilty in court. The CHP said alcohol is suspected to be a factor. Kasson Road was closed for several hours and reopened Saturday morning, FOX40 reported.
The CHP has not said what charges the Toyota driver may face, whether the motorcycle rider or the truck driver were hurt, or what any blood alcohol test showed. These are early accounts. Fault is determined by investigators and, in civil cases, by the courts, and initial findings sometimes change. Anyone with information is asked to call the CHP Tracy Area office at (209) 319-4300.
Liability for Tracy Head-On Crashes
California law generally limits when a driver may move to the left side of a two-lane road. Under California Vehicle Code § 21751, a driver generally may not pass on the left unless the road ahead is clearly visible and free of oncoming traffic for a sufficient distance to pass safely, and Vehicle Code § 23153 makes it a crime to drive under the influence and cause injury or death to another person. In civil cases, Civil Code § 1714 generally makes every person responsible for harm caused by a failure to use ordinary care, and Code of Civil Procedure § 377.60 lists the family members who may generally bring a wrongful death claim.
- The passing maneuver: The CHP said the Toyota tried to pass a tractor-trailer with insufficient clearance. Sight distance, road markings and the speed of each vehicle are usually examined to decide whether a pass on a two-lane road was safe.
- Suspected alcohol: The CHP said alcohol is suspected. If impairment is confirmed, California law generally allows a claim for punitive damages under Civil Code § 3294 in addition to compensation for the harm caused, separate from any criminal case.
- Four vehicles: The Honda was pushed into the motorcycle and the Toyota into the Peterbilt. When a crash involves a commercial truck, investigators often review the truck’s dashcam and electronic data, which can show speeds and the moment of impact.
- Insurance: A driver’s auto policy is usually the first source for wrongful death and injury claims. When limits are low, a family’s own uninsured or underinsured motorist coverage may also apply.
These are general principles of California law, not conclusions about this crash, which remains under investigation by the CHP.
Steps to Take After a Tracy Head-On Crash
The National Highway Traffic Safety Administration (NHTSA) reports that 12,429 people were killed in alcohol-impaired-driving crashes in the United States in 2023, about one death every 42 minutes. After a crash like the one on Kasson Road, injured people and families can generally:
- Request the CHP report: Ask the CHP Tracy Area office for the report number and how to obtain the collision report, diagrams and photographs once the investigation is complete.
- Follow the criminal case: The San Joaquin County District Attorney decides whether to file charges. Victims and families generally have rights under Marsy’s Law to be notified of hearings.
- Preserve evidence: Ask that the truck company keep dashcam and engine data, and save photos, witness names and any video from nearby homes or farms before it is lost.
- Be careful with insurers: Avoid recorded statements and do not sign releases until you understand your rights and every policy that may apply.
Personal injury and wrongful death claims in California are generally subject to the two-year deadline in Code of Civil Procedure § 335.1. Contact an attorney promptly to protect your rights.
