Moscow Street and France Avenue: A Pedestrian Struck in a Crosswalk Near Crocker Amazon Playground Dies, and the Driver Is Charged With Murder

SAN FRANCISCO, CALIFORNIA (October 1, 2026): A 43-year-old man who was struck in a San Francisco hit-and-run at Moscow Street and France Avenue on the evening of Thursday, October 1, 2026, died of his injuries on October 18, according to the San Francisco District Attorney’s Office. On Tuesday, October 27, prosecutors announced that a 29-year-old San Francisco man has been charged with murder in the crash. ABC7, SFist and Bay City News also reported the case.
San Francisco police officers responded to the intersection, in the Excelsior neighborhood near the Crocker Amazon Playground, on a report of a pedestrian hit by a vehicle that fled, the District Attorney’s Office said. According to court documents cited by prosecutors, a truck struck the man, who fell backward onto the street, and the driver slowed down, looked at him and then accelerated away. SFist reported that officers found him in the crosswalk. District Attorney Brooke Jenkins told reporters that the man had entered the crosswalk when the driver ran a stop sign in a Dodge Ram truck, ABC7 reported.
A witness followed the truck and photographed its license plate, Jenkins said, according to ABC7. SFist reported that police used the plate and automated license plate readers to find the truck about three miles away shortly after the crash, and the driver was detained. Prosecutors said the 29-year-old is charged with murder, driving under the influence of alcohol causing injury, driving with a blood alcohol level of 0.08% or higher causing injury, and leaving the scene of a crash. The District Attorney’s Office said it will ask that he be held without bail. He is presumed innocent unless proven guilty in court.
The San Francisco Medical Examiner’s Office has not released the man’s name, Bay City News reported. Authorities have not said how fast the truck was traveling or what the driver’s blood alcohol level was. Anyone with information can call the San Francisco Police Department tip line at 415-575-4444 or text a tip to TIP411, starting the message with SFPD.
Liability for a San Francisco Hit-and-Run Crash in a Crosswalk
Under California Vehicle Code § 21950, a driver must yield the right-of-way to a pedestrian crossing within a marked crosswalk or an unmarked crosswalk at an intersection. Vehicle Code § 20001 generally requires a driver involved in a crash that injures or kills someone to stop at the scene and help, and Vehicle Code § 23153 makes it unlawful to drive under the influence and cause bodily injury to another person. Code of Civil Procedure § 377.60 generally allows certain family members to bring a wrongful death claim when a death is caused by the wrongful act or neglect of another.
- A pedestrian in the crosswalk: Prosecutors and SFist said the man was in the crosswalk. California law generally gives pedestrians in a crosswalk the right-of-way, while still expecting them to use due care.
- The stop sign: The District Attorney said the driver ran a stop sign before striking the man. Whether a driver obeyed traffic controls is often central to a civil claim as well as a criminal case.
- Leaving the scene: According to prosecutors, the driver looked at the man and drove away. Leaving an injured person without help is a separate violation under Vehicle Code § 20001.
- Insurance on the truck: The truck, its registered owner and the policies that cover it, along with the family’s own auto coverage, may all matter when a family looks at a civil claim, depending on the facts and the terms of each policy.
These are general principles of California law. The criminal case and any civil claim are separate, and how the law applies depends on what the investigation shows.
Steps to Take After a San Francisco Hit-and-Run
The National Highway Traffic Safety Administration estimates that 36,640 people died in traffic crashes in the United States in 2025. When a pedestrian dies weeks after a crash, families often face hospital records, police reports and a criminal case at the same time.
- Ask for the case and report numbers: Contact the San Francisco Police Department and the District Attorney’s Office to confirm the incident report number and the criminal case number.
- Ask about victim services: Ask the District Attorney’s Office whether a victim advocate can explain how the criminal case will move forward and how the family can be told about court dates.
- Keep medical and funeral records: Save hospital bills, medical records from the weeks of treatment, funeral costs and any receipts in one place.
- Speak with a lawyer before signing: Insurance companies may ask for recorded statements or releases. Talk to a lawyer before signing anything or giving a statement.
Legal deadlines and notice requirements apply after a crash, injury or death, and they vary with the facts of each case, the location and the parties involved, including any public agency. Contact an attorney as soon as possible to protect your rights.
