The driver of the pickup truck remained at the scene and cooperated with police. A full investigation into the crash near Pioneer High School remains ongoing.
Liability for Yolo County Bicycle Accidents
Drivers must exercise due care to avoid colliding with any pedestrian or cyclist in the roadway. Pursuant to California Vehicle Code § 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.” When a driver fails to slow down to avoid colliding with a cyclist, this could be construed as negligence. Drivers should take several actions to avoid colliding with cyclists.
- Blind Spots: Drivers should check their blind spots before making turns at intersections.
- Turn Signals: Drivers should use their turn signals to alert pedestrians of their intentions.
- Rest: Drivers should be well rested before heading out onto the road.
- Sobriety: Drivers should abstain from alcohol and other substances that could impair their ability to operate a vehicle safely.
Pedestrian accidents are often highly complex. More than one driver could be held at fault for a collision. It is also possible that liability for any collision could extend beyond any particular driver. For example, a business owner could be liable if a pickup truck or van was being used for commercial purposes at the time of a crash. Employers can be vicariously liable for the wrongful actions of their workers who were operating within the scope of their job duties.
Common Injuries Associated With Bicycle Accidents
Many people are seriously injured in bicycle collisions each year. According to the IIHS, “A total of 1,155 bicyclists were killed in crashes with motor vehicles in 2023, the highest number ever recorded. Bicyclist deaths have increased 15% since 1975, and have increased 86% since reaching their lowest point in 2010. Most bicyclist deaths in 2023 (90%) were among people age 20 and older.” There are many injuries commonly associated with bicycle accidents.
- Concussions: Many victims of bicycle accidents sustain concussions. Any damage to a person’s brain can cause serious and lasting trauma.
- Upper Body Injuries: Another common injury that cyclists sustain is damage to their shoulders, clavicles, and wrists. Complex fractures can take weeks or months to heal.
- Soft Tissue Injuries: Victims of bicycle accidents may suffer serious lacerations and contusions. In severe cases, treatment may necessitate painful skin grafts.
- Spinal Injuries: Damage to the spine is among the most serious injuries that cyclists sustain. Depending on injury severity, spinal cord trauma can result in temporary or permanent paralysis.
Being injured in a car accident can be traumatic and disorienting. This is particularly true for children. Even after a person’s physical injuries have healed, they may be left with long-term psychological trauma. It is important that accident victims understand that they do have legal rights. They are able to seek some measure of accountability through a civil claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
