Salatiel Boton Killed in Fresno Forklift Accident

Salatiel Boton (Full Name: Salatiel Bermudez Boton), 35, of Bakersfield, Died in Fresno Forklift Accident Near Jensen Avenue and Valentine Avenue

FRESNO, CALIFORNIA (November 11, 2025) – A 35-year-old man identified as Salatiel Boton has tragically died in a Fresno forklift accident on the side of the road by Jensen Avenue and Valentine Avenue.

Fresno County officials are saying that the accident took place on Friday. Salatiel Boton was backing the forklift onto a trailer when the ramp for the trailer collapsed.

It caused the forklift to roll and trap the victim underneath. Firefighters and paramedics were called to the scene of the accident to help the victim.

Salatiel Boton was transported to CRMC’s Trauma Center with critical injuries. Sadly, he was pronounced dead at the hospital.

A full investigation by OSHA remains ongoing at this time.

Liability for Fresno County Forklift Accidents

Forklifts can be extremely dangerous and are involved in many serious workplace accidents every year. According to the Bureau of Labor Statistics, “From 2011 to 2017, 614 workers lost their lives in forklift related incidents and more than 7,000 nonfatal injuries with days away from work occurred every year.” There are many common causes of forklift accidents.

  • Insufficient Training: Forklift operators are required to obtain the appropriate certifications. They must receive ample training on all of the potential hazards that they could encounter.
  • Worksite Conditions: The conditions at a worksite can also contribute to an accident. Forklift accidents are much more likely to occur when a warehouse has narrow aisles or blind corners.
  • Mechanical Defects: Forklifts are complex pieces of machinery. Any type of defect could potentially lead to an accident. This will include brake failures and steering malfunctions. OSHA requires forklifts to be inspected at the beginning of each workday.
  • Lack of Safety Devices: Another major cause of forklift accidents is missing or inadequate safety features. For example, a forklift may lack adequate rollover protection structures (ROPS) or seatbelts to prevent occupants from being ejected.
  • Improper Loading: Forklifts are only able to handle so much weight. If a forklift is overloaded or a load is improperly distributed, this could cause the forklift to become unstable and roll over. 

When a worker is injured or killed on the job, they or their surviving family members will typically have recourse through the workers’ compensation system. This system is based off of a no-fault insurance scheme. There is no need for an injured worker or surviving family members to demonstrate that one or other party was negligent to receive benefits.

Third-Party Liability for Fresno Forklift Accidents

In addition to workers’ compensation, an injured worker or their surviving family members may be able to seek some measure of accountability through a third-party liability claim. A third-party liability claim may be possible if an entity separate from a worker’s employer contributed to an accident. There could be several sources of third-party liability for any forklift accident.

  • General Contractor: A general contractor could be liable for an accident if they directed or controlled safety operations at the site. They may have failed to maintain a work site in a reasonably safe condition and enforce OSHA regulations related to the operation of forklifts.
  • Forklift Manufacturers: The company that manufactured a forklift could also be liable through a product liability claim. Forklift manufacturers must ensure that their products are reasonably safe and compliant with regulations. These machines should have seatbelts and rollover protection structures (ROPS) to prevent occupants from being ejected.
  • Loading Company: Another potential source of liability is the contractor responsible for loading a forklift. Forklifts are only rated to carry so much weight. Exceeding these weight limits could cause the catastrophic collapse of a forklift or a ramp that it is traveling on.

Forklift accidents are easily preventable when OSHA regulations are being properly followed. But in far too many situations, companies will navigate around these regulations to expedite the speed at which projects get completed. This puts everyone’s safety at risk. The surviving family members of any person who died in a forklift accident may be able to seek some measure of accountability through California Code of Civil Procedure 377.60
