Liability for San Luis Obispo Car Accidents

All drivers have a legal obligation to exercise due care to avoid colliding with any pedestrian in the roadway. They must maintain their vehicle at a safe speed. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” Several factors could contribute to any pedestrian collisions.

  • Driver Distraction: Drivers are more likely to hit pedestrians if they are distracted by their cell phone or other objects.
  • Blind Spots: Many drivers hit pedestrians when they fail to check their blind spots while making turns in the roadway.
  • Driver Intoxication: A number of accidents involve drivers that are intoxicated. But many drivers do not realize that substances besides alcohol can impair their ability to operate a vehicle safely.

If a truck driver fails to slow down to avoid hitting a pedestrian in the roadway, this could be construed as negligence. Negligence is the failure to operate a vehicle with the level of reasonable care necessary to avoid causing harm. Liability for a pedestrian collision could extend beyond any specific driver determined to be at fault. If a truck driver was working for a city or some other entity at the time of a collision, that employer could be liable. As a general rule, employers can be vicariously liable for the wrongful actions of their workers who were operating within the course and scope of their job duties.

Steps to Take After San Luis Obispo Car Accidents

Car accidents remain one of the leading causes of preventable injury and death for pedestrians. According to the NHTSA, “76% of pedestrians were killed in collisions that occurred when it was dark, with another 4% occurring during dusk or dawn (Schneider, 2020). Retting (2021) notes that during the years 2010-2019 —a time when pedestrian fatalities have been increasing—the number of pedestrian fatalities that occurred in the dark increased by 58%, while daylight fatalities increased by 16%.” Multiple actions should be taken after any pedestrian collision.

  • Police Response: The police should be called to the same collision as early as possible so that they can begin investigating. Any report that they create should be carefully reviewed.
  • Driver Review: The purpose of any driver’s trip should be determined. When drivers are working, their employer could be liable for any resulting crash.
  • Independent Review: The family of any pedestrian who died in a San Luis Obispo County car accident should consult a legal team experienced in accident reconstruction and negligence claims.

Pedestrians are uniquely vulnerable to the hazards posed by motor vehicles. They lack the protection of an enclosed car and are much more likely to be overlooked in the first place. Even if a pedestrian is in the middle of a roadway, this does not relieve a driver of their duty of care to slow down to avoid a collision. A family of any person who died due to the negligent actions of a driver may be able to pursue some measure of justice and accountability through a wrongful death claim.
