Liability for Sacramento Apartment Explosion Accidents
Property owners in California have a legal obligation to maintain their premises in a reasonably safe condition. According to California Civil Code 1714, “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.” Property owners should take several measures to prevent explosions.
- Maintenance: Property owners should perform routine inspections and maintenance on all of their appliances.
- Fire Code: Property owners should ensure that they comply with all fire and building codes.
- Flammable Materials: Property owners should ensure that they store flammable materials in a safe location.
When a property owner has actual or constructive notice of a dangerous condition on their premises, they must take action. Failing to take action could serve as evidence of negligence. Liability for any apartment explosion could extend beyond any property owner. The company that manufactured a commercial product could also be held at fault. Manufacturers can be liable for accidents caused by defective products.
Steps to Take After Sacramento Apartment Explosion Accidents
Residential fires remain a major cause of preventable injury and death. According to the National Fire Protection Association, “In 2019–2023, fire departments in the United States responded to an estimated average of 14,830 reported structure fires in high-rise buildings each year. These fires caused an average of 33 civilian deaths, 439 civilian injuries, and $203 million in direct property damage per year.” Certain actions should be taken after any residential fire.
- Medical Treatment: Victims should seek medical treatment as early as possible. Many of the injuries associated with any accident may not be immediately obvious.
- Fire Report: Any report created after a fire or explosion should be carefully reviewed. This report can help reveal how an incident took place.
- Legal Review: Victims should consider their legal options with an experienced personal injury attorney.
It can be difficult to know where to begin after being injured in any explosion. So many victims are left with serious burn injuries. These may require expensive skin grafts and other surgeries to treat. Any person injured in an apartment explosion may be able to pursue damages through a personal injury claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
