Joaquin Anthony Pereyra Killed in Walnut Creek Police Shooting By Alvarado Avenue and Buena Vista Avenue

WALNUT CREEK, CALIFORNIA (March 24, 2026) – A 46-year-old man suffering from schizophrenia has tragically died in a Walnut Creek police shooting at a property near Alvarado Avenue and Buena Vista Avenue.

Contra Costa County officials are saying that the incident took place around 12:10 AM on Thursday. Authorities received calls about a man who was wearing dark clothing and allegedly looking into homes and parked vehicles with a flashlight.

Two officers responded to the scene and located Joaquin Pereyra. Authorities claim he was holding something that resembled a handgun. 

An officer reportedly told the suspect to drop the weapon. Joaquin Pereyra allegedly did not comply with that demand before being shot.

Paramedics were called to the scene to help the injured man. Sadly, he later died due to the severe nature of his injuries. The item he was holding later turned out to be a pellet gun.

His mother told reporters that her son suffered from schizophrenia. A full investigation into the officer-involved shooting remains ongoing at this time.

Liability for Walnut Creek Police Shootings

Police officers are required to use the least amount of force necessary for any given encounter. According to California Penal Code § 835a, “the authority to use physical force, conferred on peace officers by this section, is a serious responsibility that shall be exercised judiciously and with respect for human rights and dignity and for the sanctity of every human life. The Legislature further finds and declares that every person has a right to be free from excessive use of force by officers acting under color of law.” There are many ways that a police officer may have acted negligently prior to any police shooting. 

  • A police officer may fail to de-escalate an encounter.
  • A police officer may fail to identify themselves as law enforcement.
  • Police officers may issue contradictory commands at the same time.
  • Police officers may fail to consider or use less-lethal options.

There are many protocols that an officer must follow if they encounter someone that they suspect may be in the midst of a mental health crisis. An officer’s failure to follow a safety rule promulgated by their employer could serve as evidence of negligence. Consider, for example, Tabares v. City of Huntington Beach. Tabares was displaying erratic behavior when a police officer attempted to make contact with him. A struggle ensued, which resulted in an officer-involved shooting. The district court sided with the plaintiff’s family, arguing that a jury could find the officer’s conduct negligent for failing to follow police protocols for dealing with a mentally ill suspect.

Steps to Take After Walnut Creek Police Shootings

Far too many people are seriously injured or killed during police encounters each year. According to the Law Enforcement Epidemiology Project, “In the U.S. during a given year, an estimated 1 million civilians experience police threat of or use of force resulting in a conservative estimate of 75,000 non-fatal injuries requiring hospital treatment and 600-1100 deaths.” Multiple steps should be taken after any deadly police encounter.

Courts in California will take into consideration a number of factors when determining whether or not any specific use of force was unreasonable. In particular, the circumstances leading up to a deadly encounter matter. A police officer’s use of force may be unjustified given the totality of events, even if it appeared justified in the moment. The family of any person who died in a police shooting may be able to pursue some measure of accountability through a wrongful death claim.
