Liability for Tehama County Inmate Deaths
Jails have a constitutional obligation to provide inmates with reasonably adequate medical treatment for all of their conditions. Failing to provide inmates with adequate medical treatment is considered a form of cruel and unusual punishment and a deprivation of their right to equal protection and due process. There are many different ways that a jail may have failed to provide an inmate with adequate medical treatment.
- Medication: A jail may fail to provide an inmate with the medication that they need for a serious health condition.
- Wellness Checks: A jail may have failed to provide inmates with routine wellness checks.
- Care Plan: A jail may fail to provide an inmate with an individualized care plan. This is particularly important for inmates with chronic health conditions.
The actions of jail officials in the lead up to any death really matter when determining liability. In particular, a jail can be liable for the death of an inmate if they were deliberately indifferent to a serious medical need. This can include situations where a jail fails to get an inmate adequate emergency care. But medical neglect in a jail setting often predates any jail failing to procure emergency care.
Factors that Contribute to Inmate Deaths
Inmate deaths remain far too common across California and the United States. Many of these deaths have taken place in Tehama County. According to The Tribune, “Excluding rural counties with three or fewer jail deaths, five California counties had higher jail death rates than San Luis Obispo: Tehama, Napa, Humboldt, Shasta and Stainslaus counties.” Multiple factors may contribute to any particular inmate death.
- A number of jails across California are overcrowded. This can impact the quality of care that all inmates receive.
- Many jails have a culture of neglect and mistreatment.
- Improper safety protocols or another major issue. Weapons and illicit substances are commonly smuggled into these facilities.
Many jail deaths are preventable. They tend to involve situations where jails ignore obvious warning signs that an inmate is in distress. When a jail investigates a death, officials will nearly always come to the conclusion that the death was somehow natural. But that is often not the case. This is why it’s so important. These incidents are properly investigated by an outside party. The family of any inmate who died in custody is able to seek some measure of accountability through a civil claim.
