WHITTIER, CALIFORNIA (October 5, 2026): Zenia Chantal West, 39, was killed on Monday afternoon, October 5, when a gray sedan veered off the road at Slauson Avenue and Norwalk Boulevard in Whittier and crashed into Michael’s Super Burgers, according to her family and the Whittier Police Department, as reported by CBS Los Angeles and NBC Los Angeles. The crash happened at about 2:30 p.m.

CBS Los Angeles reported that the car struck two people. The sedan was the only vehicle involved, according to NBC Los Angeles, and a witness told the station the car caught fire after the impact. The Los Angeles County Fire Department responded.

West’s family identified her to CBS Los Angeles. Relatives said she had just left work at a nearby warehouse, was riding a scooter and was the mother of a 17-year-old son. Whittier police described the person killed as a pedestrian, NBC Los Angeles reported. A second person, a woman, was also hurt; a witness said she had a foot injury. The driver was taken to a hospital with injuries that were not life-threatening.

Police said the driver could face charges and that the investigation is ongoing, according to CBS Los Angeles. Relatives believe the driver was speeding to beat a light while turning left. That account comes from the family; police have not released findings on the car’s speed or path, and the driver’s name has not been released. Anyone who saw the crash can contact the Whittier Police Department.

Liability for the Whittier Restaurant Crash

Under California Civil Code § 1714, every driver is responsible for harm caused by a failure to use ordinary care, a duty that protects people near the road and inside the businesses along it. Vehicle Code § 22350 bars speeds that are unsafe for conditions, and Vehicle Code § 21801 generally requires a driver turning left to yield to oncoming traffic close enough to be a hazard. Based on what police and the family have said, the questions include:

  • Leaving the roadway: Police have not explained why the gray sedan left the road and entered Michael’s Super Burgers. Its path, brakes and event data recorder will be central to the reconstruction.
  • The family’s speed account: Relatives believe the driver was speeding to beat a light. That is the family’s view, not a police finding, and it can be tested against video, witnesses and vehicle data.
  • A possible left turn: The family also says the driver was turning left. If confirmed, investigators would typically ask whether the driver yielded as Vehicle Code § 21801 generally requires.
  • Scooter rider or pedestrian: The family says West was on a scooter; police described her as a pedestrian. Either way, drivers owe people outside a vehicle ordinary care, and the injured woman may have her own claim.

West’s family may be able to bring a wrongful death claim under Code of Civil Procedure § 377.60, and the injured woman may have a separate personal injury claim. Any criminal case is separate from a civil claim, which follows its own process and is usually paid first through the driver’s auto insurance.

Steps to Take After a Whittier Restaurant Crash

According to the National Highway Traffic Safety Administration, speeding contributes to a large share of U.S. traffic deaths each year. When a car leaves the road at a busy intersection, evidence of its speed can disappear quickly, so acting early helps.

  • Request the police report: Ask the Whittier Police Department for the case number and, once complete, the traffic collision report.
  • Preserve video: The restaurant and nearby businesses may have recorded the crash. Send written requests soon, because footage is often recorded over.
  • Keep personal property: If the family has the scooter or West’s belongings, keep them as they are. Their damage can help show the point of impact.
  • Ask about victim assistance: If charges are filed, the California Victim Compensation Board (CalVCB) may help with certain funeral and medical expenses.

Wrongful death and personal injury claims generally must be filed within two years under Code of Civil Procedure § 335.1. If signal timing or intersection design maintained by a public agency is examined, a government claim is generally due within six months under Government Code § 911.2.
