ADELANTO, CALIFORNIA (October 4, 2026): Elio Battisti, 40, of Adelanto, was killed early Sunday, October 4, when the side mirror of a white box truck struck him as he walked on Air Expressway near Adelanto Road, according to a written statement from the San Bernardino County Sheriff’s Department, as reported by Victor Valley News Group, and a release from the county Sheriff-Coroner. It happened at about 12:07 a.m. The Sheriff-Coroner, which identified Battisti, listed the location as Air Expressway and Pearmain Street.

According to the Sheriff’s Department, the truck was traveling east on Air Expressway when its driver-side mirror hit Battisti, who was walking west in the same lane. He was pronounced dead at the scene. The department said the driver remained there until deputies arrived. No arrest has been reported.

Officials have not released the driver’s age, who owns the truck, how fast it was moving or what lighting conditions were like on that part of Air Expressway. The cause of the collision remains under investigation.

Liability for the Adelanto Pedestrian Crash

Under California Civil Code § 1714, every driver is responsible for harm caused by a failure to use ordinary care, and that duty extends to people walking on or beside the road. Vehicle Code § 22350 bars speeds that are unsafe for conditions such as darkness, and Vehicle Code § 21956 generally requires a pedestrian walking on a roadway outside a business or residence district to stay close to the left-hand edge, facing oncoming traffic. When a truck is driven for work, the employer or owner can also be held responsible under the doctrine of respondeat superior. Based on what the Sheriff’s Department has released, the questions include:

  • Position in the lane: Deputies said Battisti was walking in the same lane the truck was using. How far the truck was from the edge of the road when its mirror struck him will be part of the reconstruction.
  • Visibility after midnight: At 12:07 a.m., street lighting, the truck’s headlights and its speed are central to whether the driver could have seen him in time to move over or slow down.
  • Shared fault: Section 21956 may be raised about where Battisti was walking. Under California’s comparative fault rules, a family can still recover even if a pedestrian is found partly at fault, with damages reduced by that share.
  • Who owns the truck: Whether the box truck belongs to a business, and whether the driver was working at the time, can determine which insurance policies and parties are involved.

Battisti’s surviving family members may bring a wrongful death claim under Code of Civil Procedure § 377.60. That civil claim is separate from the Sheriff’s investigation and does not depend on whether anyone is charged. A vehicle owned by a business may be covered by a commercial policy, so identifying the truck’s owner early can shape the claim.

According to the National Highway Traffic Safety Administration, most pedestrian deaths in the United States happen after dark and away from intersections. On open stretches like Air Expressway, physical evidence can be lost quickly once the scene is cleared.

  • Request the Sheriff’s report: Ask the Victor Valley station for the case number and for the traffic collision report once it is complete.
  • Preserve the truck’s records: Ask in writing that the truck’s owner keep the vehicle, its mirror and any dashcam, GPS or telematics data from that night.
  • Look for video: Homes and businesses near Air Expressway, Adelanto Road and Pearmain Street may have cameras that recorded the minutes around 12:07 a.m.
  • Identify the insurance: Find out whether the truck was covered by a personal or a commercial policy, and review any household auto policy for uninsured motorist coverage.

Wrongful death claims generally must be filed within two years under Code of Civil Procedure § 335.1. If street lighting or road conditions maintained by the City of Adelanto or another public agency are examined, a government claim is generally due within six months under Government Code § 911.2.
