A full investigation into the accident remains ongoing at this time.
Liability for Danville Semi-Truck Accidents
Semi-truck drivers must obtain a commercial license. They are expected to undergo specialized training and exercise the utmost care to avoid collisions. According to California Vehicle Code 22107, “No person shall turn a vehicle from a direct course or move right or left upon a roadway until such movement can be made with reasonable safety and then only after the giving of an appropriate signal in the manner provided in this chapter in the event any other vehicle may be affected by the movement.” There are several measures that truck companies should take to help prevent accidents.
- Training: Truck drivers should receive ample training on the specific rigs that they will be using.
- Maintenance: Truck companies should ensure that all of their vehicles are periodically inspected and well maintained.
- Route Planning: Truck companies should plan routes that will eliminate as many left turns as possible.
- Technology: Truck companies should consider using technological safety features such as forward collision avoidance systems.
If a truck driver fails to slow down to avoid colliding with another vehicle, this could serve as evidence of negligence. Truck drivers that flee the scene of an injury collision could also face criminal liability for a crash. Liability for a truck accident could extend to several parties beyond any specific truck driver. For example, the carrier that a truck driver worked for could bear some level of responsibility if they pushed a driver to adopt unsafe habits or to violate safety standards.
Steps to Take After Danville Semi-Truck Accidents
Commercial trucks weigh tens of thousands of pounds and can be particularly dangerous to those in passenger vehicles. According to the National Safety Council, “Also in 2024, 120,724 large trucks were involved in crashes resulting in an injury, a 5.4% increase from 2023. Since 2016, the number of trucks involved in injury crashes has increased 18%. The involvement rate per 100 million large truck miles driven increased 5.7% in 2024 to 37 per 100 million large truck miles traveled.” Certain actions should be taken after any hit-and-run semi-truck accident.
- The police should be called to the scene as early as possible so that they can begin investigating.
- All of the physical evidence associated with the crash should be sought. Even small fragments from a fleeing vehicle could be used to identify it.
- Any person who may have witnessed the collision should be interviewed as early as possible.
- The family of any person who died in a truck accident should seek an independent review by a team experienced in tort claims and accident reconstruction.
Hit-and-run truck accidents are nearly always preventable. They tend to involve truck drivers who are fatigued or otherwise not following safety guidelines. Part of the problem is that many truck carriers will push drivers to adopt unsafe driving habits. Truck accidents are often highly complex. The factors that contribute to any collision could take place hours, days, or even weeks beforehand. This is why it is so important that these accidents be thoroughly investigated by an outside party.
