Liability for Los Angeles Inmate Deaths
Every jail in California has a legal obligation to protect inmates from reasonably foreseeable sources of harm. This requires that all inmates be provided with adequate medical treatment. Failing to give inmates adequate medical care is considered a form of cruel and unusual punishment and therefore unconstitutional. There are many ways that a jail may have failed to properly care for an inmate.
- Monitoring: A jail may fail to provide periodic wellness checks on the inmates during their stay.
- Medication: A jail may fail to provide an inmate with the medication that they need.
- Protection: A jail may fail to protect an inmate from harm at the hands of other inmates.
- Emergency Response: A jail may fail to respond to an inmate’s medical emergency in a timely manner.
Inmate deaths are often highly preventable. They tend to involve major safety lapses at any particular institution. One of the major problems that jails across LA have is that they are often overcrowded. This can impact the quality of care that all inmates receive. These institutions also tend to have high turnover rates.
Steps to Take After Los Angeles Inmate Deaths
Jails across Los Angeles tend to have a very poor reputation. This is especially true with the Men’s Central Jail, which was supposed to close many years ago. According to the Vera Institute of Justice, “Fifty-two people have died in Los Angeles County jails since the start of 2023. The overwhelming majority of deaths have occurred in the notorious Men’s Central Jail (MCJ), which has been slated to close for years, yet remains open. Every day, more people enter its doors, most simply waiting for their day in court.” Certain steps should be taken after any person dies in custody.
- All of the medical records related to the incident should be collected.
- Any person who may have witnessed what happened should be interviewed.
- Surveillance footage from within the jail should be sought.
- The family of any person who died in an LA County jail should seek an independent investigation by a team experienced in constitutional claims.
It can be hard to know where to begin if a loved one dies in jail custody. To make matters worse, jails will almost never freely turn over evidence related to how any inmate died. They often claim that these deaths are somehow natural. But the fact of the matter is that many supposedly natural deaths involve some amount of medical neglect. The family of any inmate who died in jail custody may have legal recourse through a wrongful death claim.
