Liability for Riverside County Semi-Truck Accidents
Truck drivers are required to obtain a commercial license and must operate with a great deal of care to avoid collisions. According to CA Veh Code § 21658, “A vehicle shall be driven as nearly as practical entirely within a single lane and shall not be moved from the lane until such movement can be made with reasonable safety.” Multiple factors could contribute to any semi-truck accident.
- Speed: Truck drivers are substantially more likely to be involved in a collision if they are speeding.
- Fatigue: Truck drivers are pushed to complete delivery routes as quickly as possible. This can lead to them becoming dangerously fatigued.
- Vehicle System Failures: Many truck accidents involve situations where a truck experiences some catastrophic failure of key component parts.
- Distraction: A truck driver could easily become distracted by their phone or GPS and allow their vehicle to drift into opposing lanes of traffic.
If a truck driver goes through a center median and collides with another vehicle, this could form the basis of a negligence claim. There is a presumption of negligence on the part of any driver that allows their vehicle to enter into opposing lanes of traffic. Liability for a truck accident could extend to several different parties. This includes the company that owned the truck or employed the driver.
Steps to Take After Riverside County Semi-Truck Accidents
Truck accidents account for a relatively small portion of the total vehicles on the roadway. But they’re involved in a disproportionately high number of traffic fatalities. According to the FMCSA, “Of the approximately 503,000 police-reported crashes involving large trucks in 2022, there were 5,279 (1 percent) fatal crashes and 114,000 (23 percent) injury crashes.” Several steps should be taken after any semi-truck accident.
- The police report related to the accident should be sought.
- All of the vehicle fragments and physical evidence left over after the crash should be preserved.
- Any surveillance footage that may have captured the collision should be collected.
- The family of any person who died should consider their legal options with a team experienced in accident reconstruction and wrongful death claims.
Truck accidents are often highly preventable. It is important that the victims of these collisions understand they’re protected by a number of laws. They’re able to seek some measure of accountability and transparency through a civil action. This right extends to the surviving family members of any person who dies in a truck accident. They are able to pursue a wrongful death claim.
