Davis High School Student Hospitalized After Near Drowning Accident in Modesto

Student at Davis High School Found Unresponsive Before Being Removed From Pool

MODESTO, CALIFORNIA (May 18, 2026) – A student at Davis High School has been hospitalized after being found unresponsive in a swimming pool at the school.

Stanislaus County officials are saying that the accident took place around 12:19 p.m. on Thursday. Modesto Fire Department officials were called to Davis High School on Rumble Road after getting reports of a possible drowning.

A student had been removed from the pool after being found unresponsive. School staff members had already started CPR and other life-saving measures.

The student involved in the accident was transported to a local hospital to receive treatment. A full investigation into the incident at Davis High School remains ongoing.

Liability for Modesto School Accidents

Schools have a legal obligation to protect all of the students in their care from reasonably foreseeable sources of harm. Consider, for example, Taylor v. Oakland Scavenger Co., 17 Cal. 2d 594 [110 P.2d 1044], “It is the duty of the school authorities to supervise at all times the conduct of the children on the school grounds and to enforce those rules and regulations necessary to their protection.” Schools should take several measures to protect students from drowning.

  • Student-to-Adult Ratios: Schools should maintain adequate student-to-adult ratios at all times. This allows schools to properly supervise all of the students in their care.
  • Restricted Access: Schools should restrict access to swimming pools and equipment that may be dangerous during periods when there will not be adult supervision.
  • Training: Schools should ensure that all teachers and coaches have training in emergency procedures and CPR.

If school employees fail to properly supervise students in their care who are then injured in swimming accidents, this could form the basis of a negligence claim. The vast majority of drowning accidents are totally preventable. They tend to involve situations where schools are not properly monitoring their pools and other facilities. Inattention is also another major problem. Lifeguards or teachers may be paying more attention to their phones than any person in the water.

Steps to Take After Modesto School Accidents

Far too many people are seriously injured or killed in accidental drownings. According to the American Red Cross, “Every year in the United States, an estimated 4,000 die from unintentional drowning. That is an average of 11 drowning deaths per day. There are twice as many people who experience non-fatal drownings, at an average of 22 non-fatal drownings per day.” Several actions should be taken after a drowning accident.

  • All of the surveillance footage that may have captured the accident should be reviewed.
  • Medical records related to the incident should be preserved.
  • The actions of school officials leading up to the accident should be scrutinized.
  • The parents of any child harmed in a near drowning should seek an independent investigation by a team experienced in accident reconstruction.

Near drowning accidents can be extremely traumatic and harmful for victims. In many situations, prolonged oxygen deprivation can lead to severe lung inflammation and brain damage. This is why it is so important that these incidents be properly investigated by an outside party. Victims of school accidents are protected by a number of rights. They are able to seek some measure of accountability through a civil action.
