Sadly, Clark Fojas and Peter Fojas were both pronounced dead due to the severe nature of their injuries. The truck driver involved is facing a number of charges, including manslaughter and hit-and-run resulting in death.

A full investigation into the crash remains ongoing at this time.

Liability for Lodi Truck Accidents

Truck drivers must operate their vehicles with an abundance of caution to avoid collisions. This is due in part to the recognition of the hazards posed by larger vehicles. According to California Vehicle Code 21703, “The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicle and the traffic upon, and the condition of, the roadway.” There are several reasons that commercial trucks can be particularly dangerous.

  • Weight: A fully loaded commercial truck can weigh 80,000 pounds, thereby making it dangerous even at lower speeds.
  • Blind Spots: Commercial trucks have large blind spots that can obscure the presence of smaller vehicles.
  • Underride: Commercial trucks have large open gaps in the back, front, and sides of the truck. This can lead to vehicles being dragged underneath the truck.

If a truck driver fails to slow down to avoid colliding with vehicles, this could form the basis of a personal injury claim. Depending on the specific facts of a case, multiple parties could be liable for a truck accident. This includes the company that hired a truck driver. These companies have a legal obligation to ensure that their drivers are reasonably competent. They could be liable if they allow a truck driver without a proper license or work visa to work and cause a collision.

Steps to Take After Lodi Truck Accidents

Trucks account for a relatively small portion of the total vehicles on the roadway. But they are involved in a disproportionately high number of fatal collisions. According to the FMCSA, “Of the approximately 503,000 police-reported crashes involving large trucks in 2022, there were 5,279 (1 percent) fatal crashes and 114,000 (23 percent) injury crashes.” Multiple steps should be taken after any person dies in a truck accident.

  • The work status of the truck driver involved should be scrutinized. It should be determined if they have a proper license.
  • The event data recorder of the truck involved should be reviewed.
  • The employment records of the company that hired the driver should be sought.
  • The family of any person who died should seek an independent review by a team experienced in accident reconstruction.

Truck accidents can be prevented when the right safety precautions are taken. This should start with properly vetting any potential driver. Employers should ensure that their drivers are properly licensed and well trained. It is important that accident victims understand that they do have legal rights. They are able to seek some measure of accountability through a civil claim. This right extends to the family of any person killed due to the negligent actions of a truck driver.
