Liability for Beverly Hills Construction Accidents

Construction companies have a legal obligation to protect their workers from foreseeable sources of harm. This includes protecting them from the hazards posed by construction equipment in large vehicles. This requires that large trucks have warning devices. According to California Code of Regulations, Title 8, § 1592, “Every vehicle with a haulage capacity of 2 1/2 cubic yards or more used to haul dirt, rock, concrete, or other construction material shall be equipped with a warning device that operates automatically while the vehicle is backing.” Construction companies should take several other measures to prevent truck accidents.

  • Traffic Control Plan: Construction companies should create a traffic control plan that directs trucks and other large vehicles away from areas where pedestrians must frequent.
  • Backing: Construction companies should do everything they can to eliminate backing whenever possible. Backing up a large vehicle is a high-risk maneuver due to the large blind spots these vehicles have.
  • Spotter: Construction companies should use spotters to help trucks safely navigate around construction sites.
  • Vests/Visibility: Construction workers should be equipped with high-visibility vests to make them easier to spot by drivers. It is also important that construction sites are well illuminated.

When a construction worker is injured or killed in California, they or their surviving family members will typically have recourse through a workers’ compensation claim. This system does not take into consideration fault. It is designed to help workers, regardless of who could be responsible for an accident. An injured worker may also have recourse through a third-party liability claim. A third-party liability claim may be possible if an entity separate from a worker’s employer acted negligently and contributed to an accident.

Third-Party Liability for Beverly Hills Truck Accidents

Motor vehicle collisions remain a leading cause of preventable injury and death for all workers across the United States and in the construction industry. According to the National Safety Council, “In 2024, 850 people were killed and 42,094 people were injured in work zone crashes. Work zone crashes are defined as taking place within the boundaries of a work zone or on an approach to or exit from a work zone due to activities, behaviors, or controls related to traffic moving through the boundaries of a work zone.” An estimated 500 of those crashes occurred in construction zones. There could be several sources of third-party liability for any truck accident at a construction site.

  • General Contractor: A general contractor could be liable for an accident if they failed to maintain a website in a reasonably safe condition. Among other things, they may have failed to develop a traffic control plan that diverted trucks and other large vehicles away from pedestrians.
  • Truck Company: The company that owned a truck or other commercial vehicle could also be responsible for the collision. Construction sites are typically made up of a blend of different contractors and subcontractors that must all work together towards the same goal.
  • Truck Owner: The entity that owned any truck involved in a collision may also bear some level of responsibility. As a general principle, vehicle owners can be legally responsible for accidents involving their vehicle if they lawfully allowed another person to use it.

Truck accidents are often highly complex events. The factors that contribute to any specific truck accident could take place long beforehand. Part of the problem is that construction companies are often pushed to complete projects as quickly as possible. This can lead to predictable safety lapses that put the lives of workers in danger. Unfortunately, real estate developers and construction companies will almost never accept responsibility when one of their workers is injured or killed. This is why it’s so important that these incidents are properly investigated by an outside party.
