Liability for Inmate Deaths at the Martinez Detention Facility
Jails have a constitutional duty to protect inmates from all foreseeable sources of harm. When the state assumes control of a person through incarceration, they are obligated to provide for that person’s general health and well-being. This necessitates that inmates receive adequate medical treatment for all of their needs. There are many different factors at any jail that could contribute to an inmate’s death.
- Overcrowding: A lot of jails across California book more inmates into custody than they are able to properly care for. This can lead to situations where inmates do not receive the medical treatment that they need.
- Training: Correctional officers are supposed to be trained in emergency procedures and medical interventions. But the high turnover rate at many prisons often leads to correctional officers not being particularly well trained.
- Culture: Jails are supposed to treat all inmates with decency and humanity. However, many jails have adopted a culture of abuse and domination. If left unchecked, this culture can have deadly consequences.
If a jail is deliberately indifferent to the serious medical needs that an inmate has, this could form the basis of a constitutional claim. For example, an inmate may have been showing clear signs of medical distress, but correctional officers did not contact emergency services. By the time many inmates are in serious medical distress, it may already be too late. Ideally, inmates should receive the medical care that they need to avoid going into medical distress in the first place.
Steps to Take After Contra Costa County Inmate Deaths
Jail deaths remain remarkably common across Contra Costa County in the United States. Many of these deaths are the result of drug overdoses. According to one study in Health & Justice, “Opioid-related deaths in U.S. jails represent a significant yet under-researched public health crisis.” Multiple actions should be taken after any inmate dies in custody.
- All of the medical records related to the death should be collected and preserved.
- Surveillance footage that may have captured the inmate’s stay should be carefully reviewed.
- The history of inmate deaths at the facility should be scrutinized.
- The actions of jail officials leading up to the death should be understood.
- The family of any inmate who died in custody should seek an independent review by a team experienced in constitutional claims.
It can be difficult to know where to begin after any family member dies in jail custody. This grief that the person feels is often compounded by a sense of frustration. Jails are almost never transparent about how any person died in custody. This is why it is important for these incidents to be properly investigated by an outside party. Family members of any person who died in jail custody are able to seek some measure of accountability through a constitutional claim.
