She sustained critical injuries in the crash and was ultimately pronounced dead at the scene. Two other passengers in the Honda  sustained major injuries and were airlifted to Loma Linda University Medical Center to receive treatment.

A full investigation into the fatal collision remains ongoing at this time. It remains unclear if the driver of the Porsche will face any citations in connection with the crash.

Liability for Newberry Springs Car Accidents

Every person operating a motor vehicle in California has a legal obligation to obey all traffic laws and take reasonable steps to avoid collisions. Among other things, drivers must maintain a safe speed and following distance with other vehicles. According to California Vehicle Code 21703, “The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicle and the traffic upon, and the condition of, the roadway.” Multiple factors could contribute to any car accident in California.

  • Speed: Drivers are much more likely to rear-end other vehicles if they are traveling at a speed that is unsafe given the prevailing road conditions.
  • Distractions: A driver may have been more focused on their cellphone or something in their vehicle than paying attention to the road ahead of them.
  • Vehicle System Failures: Not every instance where a car rear-ends another vehicle involves direct negligence on the part of a driver. It is possible that the brakes on the vehicle malfunctioned and prevented the driver from slowing down in time.
  • Inclement Weather: Rain and other instances of poor weather conditions can dramatically increase the time it takes to bring a vehicle to a safe stop. This is why it is important for drivers to adjust their speed during inclement weather.

When drivers are operating at an unsafe speed or failing to maintain proper separation with a vehicle ahead of them, this could be viewed as negligent. There is a presumption of negligence on the part of any driver that fails to slow down to avoid hitting a vehicle in their own lane of traffic. These types of collisions are nearly always the result of drivers that are not paying attention to the road ahead of them. It is possible that more than one person could be legally responsible for a car accident. This is particularly true if a vehicle was being loaned or used for some type of commercial purpose.

How Accident Reconstruction Can Help Determine Fault After a Car Accident

Car accidents continue to be one of the leading causes of preventable injury and death for people all across the state of California. According to UC Berkeley, “Nationally, 11,775 people were killed in speeding-related crashes in 2023.  In California, there were 1,303 people killed in speeding-related traffic crashes in 2023.” Accident reconstruction can help piece together what may have caused any particular crash.

  • Vehicle Speed: Skid marks and crush damage after a collision can help investigators estimate the speed that a vehicle was traveling prior to a collision.
  • Event Data Recorder: Investigators can look at the event data recorders of the vehicles involved in the crash.
  • Visibility: Crash reconstruction can help evaluate whether a driver had enough time and distance to avoid a crash.

Ultimately, evidence is what will help determine how any particular collision took place. Despite this, drivers and insurance providers will almost never accept responsibility when they are implicated in any collision. In fact, they will deliberately take actions to undermine victims. This is why it is so important for any person involved in an accident to avoid speaking with insurance adjusters. Instead, it would be wise to seek guidance from a team experienced in accident reconstruction and negligence claims.
